I paid on Pay by Phone app but have received Court Papers

Jillski

3 years ago I parked and paid using the Pay by Phone app. I received a ticket on my car for non payment. I tried contacting Pay by Phone at the time but they said they couldn't do anything. I have a receipt for the payment made but it shows at car park in Sheffield (I was parked in Swindon, I have never been to Sheffield. Would really appreciate any help in preparing my defence for the Court. The charge is now £292.56.

Jillski said:The issue date is 19 May 2023.With a Claim Issue Date of 19th May, you have until Wednesday 7th June to file an Acknowledgment of Service but there is nothing to be gained by delaying it.To file an Acknowledgment of Service, follow the guidance in the Dropbox file linked from the second post in the NEWBIES thread.Having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Wednesday 21st June 2023 to file your Defence. That's four weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute. To create a Defence, and then file a Defence by email, look again at the second post on the NEWBIES thread - immediately following where you found the Acknowledgment of Service guidance.Don't miss the deadline for filing an Acknowledgment of Service, nor that for filing a Defence.
Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.2 -
The parking company is UK Parking Control Limited.
DCB Legal Ltd

If you follow the advice in the newbees thread and follow the well worn path - you should end up on this list DCB LEGAL RECORD OF PRIVATE PARKING COURT CLAIM DISCONTINUATIONS — MoneySavingExpert Forum

For UKPC/DCB Legal claims you should adapt the Defence written by @GolfR12.
Link here https://forums.moneysavingexpert.com/discussion/6446362/uk-parking-control-limited-via-dcb-legal-ltd-defence/p1
You need to adapt paragraphs 2 and 3 to your circumstances.
For UKPC/DCBL we advise you NOT to send a SAR before you submit your defence.

Thanks for all your help. I'll apply for the Acknowledge of Service and then start my defence. Do I then need to send the full letter, amending paras 2 and 3 as shown via the link above rather than or in addiition to the defence form they sent?0

Follow the instructions above by @Boat_to_Bolivia and submit the whole defence by e-mail to the CCBC. No need for a separate letter. Make sure that your paragraphs 2-6 make sense and suit your circumstances.2
