    Hello Iv found more information...
Happend at The Bogie Inn Cornwall last October. The firm is CPM. It was enter reg on ticket machine. And yes I have the parking ticket. This was there last response on the 5th of May..... Unfortunately as the parking charge has been paid liability has therefore been accepted. Due to this we are unable to offer a refund. Unfortunately as we are unable to discuss a dispute all further correspondence relating to parking charge notice via this email address will not be responded to.
Your advice on my next move will be greatly appreciated.
    Cheers
    Rob

Was that the response from the pub, or from the parking company??
Google search shows no sign of a "Bogie inn" but a Bowgie inn, in Newquay - is this the place? - Cornwall has many towns/villages etc

The Bowgie Inn owns both the pub car park which is free to customers and the adjacent West Pentire beach car park which is controlled by anpr, the signage is abysmal and the pub doesn't care it's a honeytrap, you will find loads of complaints on the web many for the same thing paid but still got a pcn.
You paid an invoice, getting it back will be a real uphill trawl such a pity I think you have been conned right left and centre.

If you havent already, you should put in a strong complaint to the pub, making sure to put in a few key words

You have been misslead into paying a parking charge notice , from an un regulated parking company, the pub as principal is jointly and severally liable for the actions of its agents ( the un regulated parking company)
You have tried to be reasonable and have communicated to the parking company that you had paid for parking, and had reasonably asked for a refund of the pakring charge notice, as you had purchased a ticket of which you have proof.

You have tried to be reasonable however the agents of the pub, the un regulated pakring comany have refused , as the pub is jointly and severally liable for the actions of their agents, the un regulated parking company you are now requesting the pub, as principal refunds you the cost of the pakring charge notice to the sum of £100 ( or whatever you paid the ppc) as a gesture of goodwill you will not be charging the pub for your time and costs so far, if this issue is resolved satisfactorilly .
You look forward to  speedy resolution to this issue , as you would prefer not to take legal action in the county court ( small claims track) to recover your costs - which will be higher than the original parking charge notice

It may work, it may not, but you can certainly become a real pain to the pub , and the brewery / pub company , if emails dont work then go postal

Just a heads up; it is misled and unregulated.  Your advice to the OP is abso-bloomin-lootly correct.
  • Thanks Half_way/all, much appreciated. I will let you all know how I get on. Still cannot believe no one else has been in my situation and not uploaded somewhere on the web their outcome good or bad.
    Cheers again

As with everything you could taker it to court - however there will be significant risks in doing so  and if you want to go that far its beyond my scope of knowledge, others may be able to help.

However one thing you can do is be a complete and utter pain for the pub/pub company , the usual fob off with these parking charge notices is for the pub ( or who ever) to try and worm out of all responsibility, with things along the lines of third party parking company , audited by the BPA or IPC or whatever , and even guff like industry recognised appeals service .

Adding things like principal is jointly liable for the actions of their agents, and referring to the parking comp[any as unregulated all helps knock the wind out of the bluster and gets to the point

I believe I have read a few posts from posters in your situation.  I guess they didn't post a successful outcome because there wasn't one.  You could try searching the forum but make sure you click on "Discussions" and change "Best Match" to "Newest" and only search the Parking board (this one).

We had one this past week who wrongly paid then thought he could bung in a court claim to get it back (so wrong...):
