Hello,

Just looking for advice. Recently I've received a NTK from Premier Park LTD.
Violation states "Parked in Parent and Child Bay" and I'm wandering if I'll have any luck appealing at POPLA stage.
Pictures provided are only for the vehicle parked in the bay and are taken in a way that appear to be taken by a parking enforcement agent. There is an ANPRC present on site.
The sign states "Parent must be accompanied by a child under the age of 8".
How does that tie in with The Equality Act 2010 with reference to the enforcement agents being qualified enough to judge someone's age without discrimination?
I've tried to appeal to the landowner but I was informed that even if they send an email to the parking company it has never worked in the past and I should try appealing myself.
The only potential issue I see is that the sign posted marking for parent and child bay does not match the bay marking, as well as The equality act 2010.

I'm not willing to take it to the CCJ stage as I do not have time or resources for that so my questions are as follow:

Should add anything to the blue template appeal for the internal appeal before the POPLA number is issued?
How effective will be disputing the signposted marking not matching the bay marking at POPLA stage?
Would it be better just to pay reduced bribe amount if I'm not willing to follow through to the CCJ stage?

Were you with a child or not?

I'm not saying there was or wasn't anyone below the age of 8 present with the driver but for the sake of the post lets assume there was not a child present.

Also forgot to mention that the NTK is POFA 2012 compliant.

Which section of the Equality Act do you think is relevant here? I don't think there's anything in there about qualifications for assessing people's ages.

In any event, you probably want to get this moved to the Parking Tickets board.

I had a spat with another motorist last week as we went to the shops and there was no Blue Badge bays available so parked in the nearest bay to the store which was a parent and child bay ,put our blue badge in the windscreen and thats when the row started ,i always thought the blue badge trumps everything else ( not belittling the use or need of a blue badge ) i did not think i was at fault but interested to hear other views.

Blue badge is meaningless in private car parks.

Hmmm... You're sure it's not missing the phrase POPLA said was missing only weeks ago, as reported in POPLA DECISIONS?

Not sure what do you mean by this. The back of the PCN section has an appeal section that does state POPLA number will be provided if the internal appeal is unsuccessful. I can post the edited NTK if that would help?

This is the POPLA Decision (reported by @dragoat) against which you should compare the NtK you have received. If it is similarly defective, you use this fact in your POPLA appeal.

Let us see both sides of your NtK, redacted of personal and vehicle detail, but leave showing all dates on it.

Just checked it. It does have information about transfering the liability to the driver.
Also wouldn't the date and time of the incident be easily identifiable information?
