    Yep, ignore CST.

As seen on the CST Law group thread.

Now being taken to court (claim form received) - after over 2 year hiatus. I've tried using the MSE AI tool to prepare a defence which I think is valid based on non-compliant NTK. Not 100% confident I've got it right however. Only 4 days left to get this in via MCOL (already got the 14 day extension). Anyone able to advise? Many thanks

Nobody uses that tool for a defence and I'm pretty sure it isn't designed for private parking claims. I highly doubt MSE is risking helping with court defences.

    Bin it.

Use the Template Defence. No link needed.

Thank you however I can only see a template for responding to a Letter Before Claim. This I think has gone beyond that as I have a Claim form from the County Court. Is there another template?

NB in the intervening 2 years I have A) sold the car (firstly) and B) moved house so wasn't able to see any escalation in proceedings. No idea how the traced me to my new address!

I think my main defence is there is no reference to POFA 2012 on either the original PCN or subsequent correspondence. Also wording around keeper liability seems woolly and possibly not sufficient.

No you can't only see that. Read further!

And please edit your thread title to state the parking firm and claim from which legal firm.

If its Smart Parking via DCB LEGAL and if they don't know who was driving, use the 11 paragraph template defence by user @Meltof to defend a claim form from the CNBC in Northampton using MCOL

Follow the 8 steps in the defence template thread in announcements too

If you have a claim form pack, post the issue date from the top right of the claim form below

    You should have said!

A bespoke Defence is already written for Smart claims. Here's the usual blurb, didn't you see this when you glanced at any other threads like yours?

There is a current tsunami of Smart Parking claims. So much so, that I now have copy & paste advice ready:

just click on the username @Meltof

You could have copied their version of a Smart Parking final defence posted on April 12th. Obviously, as they didn't use the POFA until 2025, theres no 'keeper liability' possible with Smart's claims for old PCNs.

These claims are all the same (none go to hearings) and the sheer numbers of Smart Parking claim threads - about half a dozen new ones EVERY DAY here - have driven us regulars a bit mad in April/May with this batch!

    Literally read any Smart thread…

Follow the 8 steps in the Template Defence thread which also covers Mediation.

It'll be discontinued just before the hearing fee falls due in the Winter.

Read @Umkomaas' thread of over 860 examples . And counting!

With great relief found the12th of April post from @Metlof on the @sluzz thread 'Smart Parking claim via DCB Legal? Group info thread’ which I believe is the up to date wording. Will check/edit for specific facts & submit. Many thanks again.
