ID3 Question

Good Afternoon,

Long story short after the death of my Father his share of the property that he owned with my Mum is going to be transferred to me and my brother as per the instructions in his will. I have looked at the LR website and taken advice and I am aware of the forms and documents that need to be supplied (AP1, TR1 plus certified copy of death certificate) however I've hit a bit of a stumbling block with form ID3. Whilst there is someone, a family friend and Navy officer, who can verify my brothers identity my brother no longer has a valid passport. His passport, assuming he can find it, expired some years, possibly even a decade ago.

I have two questions please - 

Does this preclude him from using Form ID3 and if so what are his options?
Can my Mother and I still use form ID3 if my brother has to use an alternative form/process?

    Is/was the property owned as 'Joint Tenants' or 'Tenants in Common'?
    Who is/are the Executors?

    Form ID3 relies on a passport as part of the verification so if no current passport he can’t use form ID3 - see PG67 which explains what’s required and the acceptable forms re ID1 or ID3


    If the property was registered in joint names then you are correct re forms AP1 plus TR1 by Mum to Mum plus the two of you if that’s what you’ve decided to do.

    That's lovely thank you. So in this case he will need a form ID1 with his identity verified by a solicitor and my Mother and I can use form ID3 as we have valid passports.

    Property was/is registered in the joint names of my parents as tenants in common for info.

    TIC impacts on the beneficial ownerships and may, in some circumstances, cause the legal ownership to be transferred in the way you intend. 
    If there’s a form A restriction on the register and the three of you split the beneficial ownerships, then that will stay on the register 
    I always recommend that beneficiaries and surviving owners get wider legal/financial advice as well as there are options to always consider.
