Sorry for the slow update but received letter from the court yesterday -
It is ordered that:
1. Judgement set aside and any warrant or other enforcement discharged
2. The draft defence filed shall stand as Defendant's defence.
3. No order as to costs.
I've also been sent a Directions questionnaire, so I suppose I'll just fill this out and expect another hearing at some point?0 -
Yes but obviously read KNOW WHAT HAPPENS WHEN (red capitals heading) in the 2nd post of the Newbies sticky thread because there's a vital Witness Statement and evidence bundle for you to do before the hearing.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you, I'll make sure to look that over and prepare a witness statement with related evidence.0

- the DLUHC DRAFT IMPACT ASSESSMENT CALL FOR EVIDENCE thread I started this week, and
- go to the end of the Template Defence sticky thread and grab the example WS wording that I posted (also this week) and
- then go find v3 of the full WS bundle example (with exhibits and index sheet) posted by @aphex007 in their long defence thread this year. That shows you what the whole bundle looks like BUT MY WORDING ABOVE IS NEWER for the actual statement.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

".....and I'm pretty sure I could win should VCS pursue the claim."
A heads-up - you will see that in the above mentioned WS example they refer to the BPA CoP because they are BPA AoS members - your claimant is an IPC AoS member so you should be using/quoting the relevant version of the IPC CoP.

Just a quick update, I've used your advice @Coupon-mad and taken the latest template defence and WS bundle as suggested. I have sent my WS bundle now to the county court, and await a hearing date to be set.

Just a quick update - received a letter from the court, I opted not to attend due to work commitments.
"Upon hearing the Solicitor's Agent for the Claimant
IT IS ORDERED THAT
1. Claim dismissed.
2. No order as to costs."
Thanks again, you guys have been a great help.3 -
