Currys sent wrong laptop and won't replace

Hi...
This is a bit of a strange one...
I ordered a blue Lenovo i3 laptop online at Currys on the 28th March and it was delivered the following day. As it was for a present, I left it in the packaging, ready to wrap yesterday. When I opened the packaging, I found that they had sent me a Lenovo laptop in silver, with a less powerful, pentium Gold processor and not the i3 processor I had paid for
I rang Currys helpline today, but as it is over the 30 day period for their refunds/replacement policy, the lady on the phone, basically told me it was my fault that I hadn't checked (Can't argue with that I suppose) but even though they had sent the wrong spec laptop in the wrong colour, they would not replace it, as their policy takes precident over any possible rights I may or may not have.
Can anyone give me any advice? or am I stuck with the laptop they delivered, incorrectly?
Thanks
Baz

They're wrong about their policy overriding your rights. That's complete nonsense.
How did you pay?3 -
Paypal (Pay in 3 installments)

I'm not 100% clear on your rights - the item is clearly not as described but I'm not sure if that means you only have the right to reject it during the initial 30 day period or whether that right continues on for the first 6 months according to the CRA or indeed whether you have any time during the 6 year window that you can bring claims to reject it.
What I am 100% clear of is that no retailer terms can supercede your legal rights.1 -
OP have a look on the CEO email site for Currys and use he contact email there to raise the issue.
There's no time limit to raise an issue like this, Currys know this but will train staff to stick to policy, their executive office will know what the regs state and likely either agree to a refund or a swap.
In the game of chess you can never let your adversary see your pieces1 -
I've got a call booked with one of Currys managers and just spoken to PayPal. The lady at Paypal stated that regardless of what Currys policy is, as I paid via Paypal, I have 180 days to raise a dispute and as the item they sent was "signigicantly different" to what I ordered and paid for, PayPal will sort it!!

They've sent the wrong item; they are conflating their cooling down right to return with your legal rights to get the item you paid for.I had a run-in with Currys a while back where they sent me a lower spec item that the one I purchased, tried to send the same wrong item again as a replacement, argued that they had to verify the return before refunding, messed about to the point that I was going to open a credit card dispute, and eventually refunded me.I think they do it in the hope you'll just go away and leave them alone; the customer is always wrong.3

I wouldn't buy from Curry's without being prepared to discuss with them their curious interpretations of which laws apply to them...
And I certainly wouldn't trust them to pack the correct thing in a parcel (having many years ago lugged a new telly home from Dixons on public transport, only to find they had picked the wrong one from the stockroom....).1 -

This is significant as it makes a difference between "change of mind" and "goods not as described".1 -

They told me that the Consumer Rights Act doesnt apply to them
I ended up getting a full refund0 -
