pedalpowersailing said:Hi
have been reading details on the forum and wondered if I could get comments.
I have had an appeal rejected by ias today. Not surprised at all, but wondered what I should do next.
my appeal was based on the fact that there were no signs at an entrance point ( proved by photos)
they sent a google image showing multiple images of signs, most no longer exist (again photos)
they told ias that there were signs at the entrance ( in email) which is not true.
ias state they believe there is sufficient signage and invite me to pay within 14 daysThat evidence is a total farce, it's laughable, and the IAS went along with it?They are basically saying that their made up evidence to reject your lack of signage claim is based on a historical web search as they have no up to date photos to disprove your claim. A judge would laugh it out of court IMHO!3 -
You will not get landowner details from a pakring company, you need to either use a little local knowledge or search google if its a retail park a search string along the lines of name of retail park plus sign units can often point to the landowner.Failing that then you will need to search the land registry, and for this thre is a small fee.If this is the site : https://www.google.co.uk/maps/@52.9269294,-1.2787057,3a,90y,21.35h,88.33t/data=!3m6!1e1!3m4!1sSJuNym_CaFNo9YfGrBOYxA!2e0!7i16384!8i8192Then it looks like a scabby peice of land, and probably a good hunting spot for the parking company as it looks like to could be a car park for the sainsburrys local , it also means that finding the landowner may involve a land registry search.

Ask the local council who pays the non-domestic business rates.2

Only reason I ask is that in my case, although I am right from a common sense position, the operators position does have some legal validity. In a nutshell, I parked, was on phone so didn’t buy a ticket immediately. Operator signage states buy a ticket within 5 mins and I didn’t so there is the validity. My argument is that the ticket I did eventually buy covered the entire time that I was parked (didn’t buy a ticket for 20 mins after arrival, ticket valid for 20 mins after I left)
Any advice appreciated0 -
The advice has already been given above.
Follow it
