  • I finally received my questionnaire and have sent it off to CCBCAQ and DCBLegal thisevening after following instructions on the other posts. The letter was dated 14th August and I had until September 1st to file it, unfortunately I wasn't even around when it arrived (I travel a lot) so I'm a couple weeks late myself. I'm hoping with all the delays they've had their end, they don't reject my submission for being too late.

    It's fine. They didn't post it on 14th August.  They've been posting them 3 weeks late.

    Make sure you email it, as per the first 12 steps of the Template Defence thread.

    Some more correspondence from DCBL thismorning, 'Without prejudice save as to costs', 'Our client may be prepared to make an offer to conclude this matter'. Ignore it, I assume. Feels like a last ditch effort though :)

    On your way to a discontinuation. Expect to see you reporting that in the next few weeks (maybe even days).

  • 5 weeks after I submitted the questionnaire (on September 21st), I recieve by post an 'Order' to file the questionnaire. After spending 70 minutes in a queue to speak with CNBC, I was informed they are still working through the email backlog and are currently on September 18th, so I am to ignore the letter and check again in a week.

    I would not ignore an order.

    Forward your September email again, saying you are doing so to comply with the sanctions Order dated xxxxx as you have no faith in the overloaded CNBC who seem to prioritise Claimants with an auto-CCJ conveyor belt system but drop the ball on everything else.

    But also:

    Please take a moment to provide your evidence about delays to this Justice Committee Inquiry:

    Please also state that private parking firms and their bulk litigators are the problem as far as small claims are concerned. Parking claims make up over a QUARTER of all small claims according to MoJ info divulged in the DLUHC's recent Parking Code of Practice draft Impact Assessment.

    These generic roboclaims churn through the system, clogging up court time over meritless rip-off PCNs where the POC are boilerplate and lack even the most basic details of the alleged breach (please show your own Claim form as evidence to the Inquiry).

    They are inviting evidence, not rants or bare opinion, so we need people like you to respond, who are currently caught up in a PPC claim and can attach the above evidence.

  • Looks like they got caught up. MCO now says I filed a DQ, and I got a letter saying it's been transferred to my local court.

    In the meantime please do a reply to the Committee (above) with your Claim Form (redacted) as evidence of the sort of meritless 'cause of action' that is wasting the court's time.

    You want to change things? This Committee is your voice.  The Government is already regulating the private parking industry, so they are listening and are aware of the scourge of unfair PCNs from rogues and bulk litigators.

  • Hi, I'm in the middle of arguing about a pcn from the very same KFC Newark carpark for parking out of hours. It was exactly a year ago. I have made it clear I do not agree to any terms, conditions or consent. I had the offer of a mediator from the Northampton County Court business center which I accepted just to see what Dcb legal would say. I offered them a nominal £5 as a gesture without accepting any liability. Dcbl came back with £170! I told the mediator I will see them in court. Here's the thing, the signage as you turn into the carpark from the right was rotated away from the driver so the view of the sign was restricted on entering the carpark. Viewing it on Google maps shows it has been like that for a couple of years.....I went past it a couple of weeks ago and now the sign has been corrected. Surely that's an admission the signage was wrong?
