That says to me that the Claim is struck out, therefore there is no case to answer, no defence required against a null case and therefore no witness statement required either. Do keep all your evidence and paperwork though because it has been known for claimants to claim that they did comply with the orders and the CNBC court must have lost it.1

This is from the allocated court at Manchester. The CNBC has had nothing to do with this since it was transferred.
The Manchester judges appear to be very switched on when it comes to these rubbish claims from the roboclaim solicitors. However, it would have saved everyone's time (including the courts) if they'd just struck it out when the original order was made. If the PPC/solicitor failed to follow the requirements of the CPR PDs when first filing the claim, the PPC/solicitor should not have been given a second bite at the cherry. They are not lay reps unused to the court system. They file these claims hundreds of thousands of time a year and should know better.
It appears that the roboclaim time wasters are given far too much leeway. If they breach the rules, that should it. Rules are rules.
Anyway, well done to OP for persevering and a valuable lesson learnt for any future PCNs.4 -
