    I received a letter today from debt recovery (Trace Debt Recovery) asking for a payment of £150.

    I am still waiting for the response from the PALs and CEO team and not received any response yet.

    What are my options, any suggestions ? Can I ignore this debt collection letter ??

    Just do what the NEWBIES thread already says (in the 4th post).

    Sadly, this forum is nowadays so busy with court claims/defences that we have no time to offer to discuss ignoring laughable threatograms, which is why this standard stage is covered in the Newbies thread.

    I have finally received an email from the hospital trust and pasted below is their response. 

    I am resting my case on the guidance from the trust that parking charges should be based on the entry and exit time and the system implemented by the parking administrator should follow that regardless of the option they provide to customers ... be pay via the app or get a ticket from the parking machine. If you pay via the app, it does not charge/limit your charge based on the entry and exit time, I entered the premise at 4:45 pm and exited at 23:15 pm.

    Thank you for your emails to the Trust expressing concerns about a Parking Charge Notice (PCN) issued by Wise Parking. I have reviewed the matter and would like to advise you that the PCN was issued correctly.

    Based on the evidence below, it is clear that on 30/03/2023, you made payments of £4.70 for parking between 4:48pm and 8:48pm, £1.70 for parking between 8:57pm and 9:57pm, and another £1.70 for parking between 10:17pm and 11:17pm. The PCN was issued because you did not purchase or pay for parking beyond 11:17pm. In your complaint, you mentioned being on site for 6 hours and 35 minutes, but you were penalized because you only paid for 6 hours and 10 minutes.

    In the car park, there is an option to purchase a £6 ticket that is valid for 8 hours. If you had chosen that option, you would not have been penalized. However, the option you selected required you to stay on top of payments. Making small payments does not accumulate to cover the full time on a reduced ticket.

    When you enter a private car park, such as the one you used, you are essentially entering into a contract and agreeing to abide by the terms and conditions set by that car park. The terms and conditions are clearly displayed on signage throughout the car park. If these conditions are breached, enforcement procedures must be followed.

     

    The procedure for PCNs in our Trust is as follows: if a PCN is issued, the driver has the option to either appeal or pay the fine to Wise Parking. If the driver's appeal is unsuccessful and they wish to contest the PCN further, they can escalate the matter to the Independent Appeals Services (IAS). If the driver remains dissatisfied with the outcome, they have the option to seek legal guidance and contact the Healthcare Ombudsman.

     

    In your correspondence, you correctly referred to the NHS car parking guidance, which we adhere to. While there is no further action the Trust will take in your case, I encourage you to follow the guidance provided in car parks and wish you the best in resolving your case by following the afore-mentioned steps.

    Just ignore Wise. No trying IAS.

    You don't owe anything.  It's not a fine and there is no appeal worth trying with IPC firms.  They are all the same.
