New style ESA

Just got a phone call from DWP and pension saying that there is question in the ESA application online about.
Sharing the outcome of an assessment with your doctor. Asking why I have not given consent what's the reason. I told the lady on the phone it said the consent is voluntary and that's why I put NO. She said to me that if I dont consent then DWP can't put my claim on the system and will need to be done Clericaly which will result in delay. I felt pressured and then consented.


Is this a normal process has any body else had this from DWP ?

    You do not have to give consent to share anything with anyone. I've never heard that it can affect the process of a claim before. We has some members that work for DWP so they will be able to confirm if it's correct or not.

    No that is not normal - and insinuating that it could affect your claim is outrageous.
    It's not that long since the DWP were made by law to ask your permission rather than just telling your doctor of the assessment outcome.
    It's probably just a case of poor staff training, but shouldn't happen.

    Do you think I should go with the flow even though DWP are in the wrong. Or phone DWP and take my consent back. My only worry is that my claim being delayed and receiving my money late?

    Your claim will not be delayed even if you ring them to tell them you do not give consent to contact your GP with the outcome of the WCA.

    Work Capability Assessment, the health assessment they do for ESA (and for UC, for anyone claiming that).

    Up to you whether you consent or not.  It means the work capability assessment centre cannot contact your Doctors for any information which might have helped the process.

    If ESA don't have consent, they will have to clerically maintain your claim records, but does not necessarily mean delays. Any manual process has the potential to be slower, as processing is different to normal process.
    The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.

    Not at all, they may still contact your doctors for information - you are not witholding consent for that.
    The consent being discussed here is the consent for the DWP TO TELL YOUR GP what the outcome of your assessment is.
    What you sign to on the ESA50 form is:
    I agree to my doctor, or any other doctor
    treating me, being informed about the
    result of my Work Capability Assessment.

    There is only ever one reason for the DWP to do that - to tell the GP not to issue any more Fit-Notes because the DWP had found you fit-for-work.
    It clearly states that on the ESA50 just before it asks for that consent,
    it also clearly states:
    You do not have to give your agreement.
    If you do not agree, it will not affect your
    claim for ESA. We will keep a record of the
    decision you make.

    I got confused as well about the consent as well.

    Wondering now if OP  gave consent for DWP to contact Dr about medical history.

    result of my Work Capability Assessment. So they don't have to give further sick notes.
