ParkingEye Cambridge Retail Park

Hi all,

I have received the PCN from ParkingEye regarding our visit to the retrail park in Feburary and it is at POPLA stage now. The PCN states that the car had stayed in the car park (according to their ANPR system) for 4 hours 10mins and 11seconds in the car park. The car park is free for 4 hours. So I think I should be appealing the grace period as the major point at POPLA stage. The PCN does look POFA compliant (with the paragraph on the back of the PCN) by the way. I'll try to post an image of the PCN soon (just need some post processing to remove number plate etc).

I have received the POPLA code on 16th of March. If it is still up to date, should I have 33 days from then to do the POPLA appeal? That means only a week left. I'll try to put together an appeal as soon as I can. Appoligies for being late on posting this, been very busy with life and work recently.

I have found the following appeal I could adapt to in my case (wasn't able to find a more recent one, hope this is not out dated yet?):

I've seen mentions about a new government CoP. Should I be appealing based on the new CoP instead of the BPA grace period?

    Just to elaborate a bit more on what happened:

    So on the day we have visited Lidl, Homebase and Nandos with the family with two young kids. I have contacted the retailers and restaurant regarding the ticket. Only Homebase was initially willing to help, but later replied saying that the car park was owned by separate landlord, so they cannot do anything about the PCN. None of them was willing to share the details of who the landlord is or their contact details (Homebase simply says they don't have the contact details).

    The phone number of Cambridge Retail Park (from google) just hungs up when I tried calling. I tried the email address from here (not sure if they are relevant though): https://cambridgeretailpark-future.com/

    But have not received any reply yet.  The POPLA code is about to expire. I'll try to do the appeal route now. Any hint or help would be much appreciated.

    Can you ask Homebase for a contact email for the landlord or property agent, so you can complain to them.

    Can you ask Homebase for a contact email for the landlord or property agent, so you can complain to them.

    I did. This is their reply:
    "I cannot pass on those details as we do not have them.
    Sorry for the inconveniences."

    Not sure if it is helpful to post the PCN here. ParkingEye PCN might look all the same (Let me know if I'd better remove them)..

    Yep that's POFA compliant.

    I think you should spend the last few days digging to find the property agents - are they not listed at the bottom of the retail park welcome plinth (listing the retailers) at the entrance?  Usually are...

    Also how about asking Sainsbury's to please forward your complaint & receipt to their landlord and asking for them to help?  A word from Sainsburys in the right ear might be enough.

    Also when you appealed to PEye you did attach all your Sainsbugs receipts (or proof of payments over the months) including that day?  PEye do consider receipts.

    Also, "arrival time" and "departure time" are not "parking time". Do their signs actually say: "...a Parking Charge is applicable if the vehicle remains within the car park for longer than the 4 hours 0 minutes max stay time"?

    A brief look at one of the signs shows that it states "Up to 4 hours free parking".

    Also, those signs are terrible, considering this is PE>

    Some good advice here. A quick look on google map, JLL appears at the bottom of the plinth. I'll drop them a email first.

    It is Homebase though. I'll drop them another email. Although their "CEO response team" might be feed up with my emails by now :)

    I did not attach the proof of payments :'( I have already gone past the stage now. Should I write a complaint email to them with the receipt now? Or is it too late for that?

    I'll certainly include the point in the appeal!

    Interesting, I kind of thought the sign was not this bad. Beehive center is next door. I'm sure the sign there was different. I'll need to go take some pictures of this.

    I'd do a complaint to JLL attaching your receipt and a pic of the offending PCN (so they can see the ref) and copy in Homebase AND ParkingEye:

    That way you'll force your receipts under PE's nose and annoy them that you are involving JLL.  That can make PE furiously backpedal.  Especially as the sign offers 4 hours PARKING not 4 hours TOTAL STAY (different thing).

    I would be suggesting to JLL that they must talk urgently with PE because a statutory Code of Practice is finally coming in within a year, where the Government have stated that there MUST BE at least 15 minutes in addition to parking time (5 mins on arrival as a consideration period and an additional minimum 10 minutes after, as a grace period, and they will BOTH APPLY). PE have admitted in BPA publications that they are liaising with Government on the new Code, so know about the detail of the new Code full well but are currently not changing their policies yet.  Say how angry that makes you feel.
