    Foxy -

I think I'd ring PIP for clarification of whether the decision resulted in a downgrade to the DL standard award,
Also request another copy of the decision letter (preferably dated that day) with the points listed - if you have still not received a PIP decision letter.

This might clarify things - you may need to ask to be transferred to a supervisor if the call handler is uncooperative.

That was before your PIP assessment though, as you said that was 3 weeks ago?

The absolute deadline for an MR is 13 months.

Hillstreetblues, (sorry don't know how to do 2 quotes). My PIP enhanced daily care is  £92.40 per week. The ESA letter sent dated 10th March, NOT received until 30th March, shows my new ESA rate from 11th April, as ESA only, does not include the disability payments that I get due to receiving PIP.

I apologise to the op, for hijacking their thread, should I start a new thread?

Was your PIP due to end around the time they sent the ESA letter by any chance? If so then this is likely why the SDP wasn't included in the calculation.

Would be grateful if a mod could split this post, as I think I am going to need advice if I have to do a MR.

Poppy, it was due to end July 2021, but was extended due to covid. I did get the renewal forms a month or so before then, but didn't have the assessment until March this year, so was lucky to have got a bit of extra time.

One letter I had forgotten I had received was the new rate of PIP from 10th April, stating this would be £101.75 which is enhanced, now that was dated 13th April, so the ESA letter dated the 10th is confusing everything.

I do intend to call both PIP and ESA Tues. not sure if I will get through, can imagine after the holidays they will be busy, was on hold 1hr 40mins with ESA. I always make a note of date, time and who I speak to. Will be asking for the Assessor's report as well, as she told me she had not looked at the forms I had filled in, which I thought was strange. I was awarded 15points by the Tribunal and those still apply. Thanks to everybody for helping.

All you can to is wait, as atm can only best guess what has happened.
It always seems it's the weekend when you need to sort something out, even worse the Easter one.

Do you know the breakdown of points the Tribunal awarded you?  As  that will be the start point for a MR/appeal.

Yes it couldn't have happened at a worse time being Easter. Yes I have the tribunal papers, so I have the total breakdown of all points awarded, that I can refer to. Will update when I get further info from DWP.

Well it is not as bad as I thought, dropped from Enhanced to Standard. I was put through to a Case Manager as my file does not show that a decision has been made yet. But it was made on 29th March, no letter has been sent out yet, so she is sending that plus a copy of the assessor's report, (that will show me where pts have been dropped). Awarded 10pts, given 15pts at tribunal in 2017. Will have to think carefully whether to request a M.R. as some payment is better than none. At least this time I am only fighting PIP, lost PIP and ESA in 2017 and had to go to tribunal for both. Still no ESA payment, still trying to get through to them on the phone, but apparently my next payment is on 21st April £204.84, so last weeks' payment is somewhere. At least after 16th April I will never have to deal with ESA again, as reach state pension age.

  • Sorry to hear they downgraded you. The date of the decision works out with what you got paid.

It would have been a total cliff edge if lost completely about £145 less a week then you will getting now.

With a tribunal they can stop at 15 points as they don't need to award you any more.
So being awarded 15 points doesn't mean you weren't entitled to more points than that.

I have received the PIP award letter and Assessor's report. As previously stated DWP gave 10pts, Tribunal 15pts.
Preparing food, Assessor has stated that I need supervision or assistance to prepare or cook a simple meal, 4 pts and Tribunal awarded 4pts in 2017. DM has said Needs to use an aid or appliance 2pts only given.

Taking Nutrition, Assessor states I need assistance to be able to cut up food, 2 pts and 2pts awarded at Tribunal. DM no points and states there is no evidence to suggest reliability with this activity without use of aids.

Needs assistance to get in or out of a bath/shower, Assessor states I am unable to get in and out of a bath without assistance, 3pts, 3pts awarded at Tribunal. DM has only given 2pts for You need an aid or appliance to wash or bathe.

I know it is my decision, but is it worth asking for a mandatory reconciliation, reading the benefits forums on MSE for years, am I right in thinking that if it went to tribunal the Courts would tell me if I was going to lose the lot, I could then pull out and keep standard rate? Any comments gratefully received.

The most likely outcome of the MR is the decision will remain the same. 73% of those that either appear in person or have a telephone/video hearing have a decision in their favour. If there's any risk to a current award they should warn you before removing any points. This will then give you the chance to think about it and either cancel the hearing or proceed at your own risk.
