Letter from QDR solicitors after 4 years

Hi

I have been through the process before and actually was able to defeat these cowboys in court, yet they are back again so I presume there is a good chance they take me to court so would be grateful of some advice.

Around 4 years ago I went on a speed awareness course at a hotel and my car was in the garage so I went in my small camper van. When we got there we had to put our Reg into a iPad so we wouldn't get a ticket, now as I always use my car I automatically put that reg in by mistake. 

A few weeks later a letter arrived from some parking firm and then I instantly realised what I had done. I went to the hotel to explain and at the time had all the proof from letters from the police with the date on I attended, my documents for my van etc. The hotel rang me back the next day and said that it is all now cleared up and that was the end of the matter. Which it was until I received a letter a few weeks ago after 4 years chasing me up for this fine. How the hell after 4 years it has appeared I have no idea, especially after supposedly getting cancelled.

I have explained the situation to the cowboys but they just ignore anything I say and keep sending letters. The trouble is now I don't have the letter from the police with the date on it, no proof from the hotel as it was just a call telling me it was over, so how can I prove it. 

I will not pay and will go to court if needed but is there anyway to prove what I am saying, do they have any case at all?

    All the info and guidance you need can be found in the NEWBIE sticky and it seems like you have tried Plan A but you need to go back to the hotel and ask them to sort out their agreement to get it cancelled.  How did you explain the situation to the cowboys - phone, letter or e-mail so you have a record of what you/they said to each other.

    Ring the hotel manager and ask if they have kept a record of cancelling the PCN.

    Well, you certainly don't pay them. As you've had experience of this kind of scam previously, you should remember that all you can do for now is either follow up Plan A and get the hotel to get the PPC to cancel the PCN. You have already learnt the hard way that a telephone call is as good as the paper it's written on. Everything should be by email preferably. If you have to call anyone, it should ONLY be to get the correct email address for correspondence.

    Apart from Plan A, if you've read the Newbies/FAQ thread (not just skim-read) you will know that you ignore everything from the scammers and only need to respond to a LoC should they decide to go that far. hey have up to 6 years from the date of the parking event to issue a Claim.

    You ignore all reminders and debt collection threats. They are harmless and designed to solely frighten gullible victims into pooping their pants and paying up the, by now, inflated fees.

    If/when you receive an LoC, you brush up on what to do as described in the second post of the Newbies/FAQ thread.
