Brought Washing machine from Currys 10 months ago it's now gone wrong advice needed?

I wonder if any one can give me some advice.
10 months ago I brought a washing from Currys. 
I got it at a discount as it had a few small marks and scratches.

It was sold as refurbished but they said that it was only marked as refurbished because it had some marks and scratches. And could not be sold as brand new because of this.

But it was basically brand new, it was still sealed in original packaging and had never been used.

I paid £450 instead of £700.

It had worked fine and was really happy with it until Friday.

Friday I put on some washing, I  noticed it started to get more and more noisy and washing machine was shaking like crazy.

Washing machine had never done this before.

I checked washing machine, removed some cloth but it was the same. 
I tried with empty washing machine same thing.

On looking closer and examining washing machine I noticed drum was moving back and forth.

Drum seems loose with a lot of movement back and forth. It still spins fine.

After doing alot of research I  think it's the spider arm bracket that's broken.

I contacted Currys but they claim it only had a 3 month warranty. And that it's now out of warranty and they don't want to help.

I contacted Samsung and they were helpful, went through trouble shooting steps with me and agreed it does sound like the spider arm is broken.
They said it's very very unusual for the spider arm bracket to break so quick. And was most likely faulty to start with.

They told me to contact Currys where I brought it from. But so far Currys don't want to help.

I have looked into having it repaired, and allthough the part costs only £100 most places I've asked have said it will cost  £500-£600 to repair as it's a time consuming repair 

To replace Spider arm bracket you have to completly strip down and take apart washing machine and remove drum.

I am not keen to pay that much to get it repaired, it's alot of money. Would probably be cheaper to buy a new Washing machine.

Don't really want to have to buy a new washing machine, can't really afford it as my husband had a accident last week and now can't work. This was all I needed,  but might have no choice 

Before I go out and buy a new Washing machine do I have any rights under the sales of goods act or are items sold as refurbished not covered under sales of goods act.

It was essentially brand new only sold as refurbished due to the marks. I expected it to last more than 10 months.

Any advice much appreciated

  • No I wasn't aware. I thought it still came with a full years guarantee. That's what I was told at time

    That is a massive discount for a few marks. I cannot help on the legal side, I would say that you have been unlucky.

    Ys, that was indeed a massive discount.

    About being unlucky, most washing machines, well every mache we have had has broken down within 2 years and our machines are never overlaoded and looked after.

    Currently, bought last year I think or year before, we and our kids all have Samsung washing machens as reviews were goo 9kg loads, realtively compaact when compared to previou machens and very, very quiet

    Thnaks OP -  I have read many threads that help people where their machine etc has broken downn outside the warranty period but this is why, for better or worse take out enxded warranties but hope they dont break down but for a peace of mind

    Does the paperwork/invoice mention guarantee?

    Does their website have info about gurantees on refurbished goods?
    Things that are differerent: draw & drawer, brought & bought, loose & lose, dose & does, payed & paid

    If you cant get currys/samsung to repair it have a look at AO outlet on ebay in future. They offer a 1 year warranty on their products and they wont attempt repair they just exchange it from another product on their site (obviously if its more expensive I assume they charge you the difference). 

    Ive brought an oven, dishwasher and now a washing machine from them and other family members have brought from them and always very helpful customer service. 

    I must admit we did have an issue with extra damage to the dishwasher and the power cable missing on the oven but they refunded a proportion of the purchase price which covered buying the oven power cable and the extra damage to the dishwasher doesnt affect the use. Both are nearly 2 years since purchasing now. Washing machine brought recently and had no issues was even in original packaging when it arrived. 

    I do hope Currys help you though!

    Does it being sold as a refurb invalidate the original 12m manufacturer's warranty? It's not clear why Samsung referrred you back to the retailer if this is still in place?
    Did you not check at the point of purchase what warranty would apply to a refurb sale?
    Otherwise your only option is a claim under CRA 2015 against DSG as the retailer. Forget SGA, that was suoerseded years ago.
    As it's more than 6m old, you will need to supply an engineer's report confirming a pre-existing fault. 
    No free lunch, and no free laptop ;)

    Warranty would be from Samsung. NOT Currys..

    So have Samsung confirmed it only had 3 months? 
    Did you register it with Samsung?

    Surely exercising consumer rights is the way forward here, not warranty? The warranty (and the uncertainty over its length) is a distraction.

    OP, get the machine inspected, hopefully with the same verdict that Samsung have provided remotely, and go back to Curry's for a resolution, be that a repair, a replacement or a partial refund.
