Consumer law on iphone with failed antenna :-( (EE)

    As it’s more than six months since purchase, you’ll need to prove the phone is inherently faulty. The fault was there (but not apparent when you bought it). Or that it is not of merchantable quality (it should have lasted longer than it has)

    Unfortunately, Apple reports say what the fault is but not how it occurred or, more importantly, why they believe it to be the case (what testing they did) So you might need to pay for a full report. 

    Having said that it’s possible that EE will accept the report. But that’s a discussion between you and them.

    Sorry for the delay, bit of an update.
    They fixed it quite quickly which surprised me., unfortunately the exact same fault happened within a week of me picking it up again so not happy.
    Spent an hour and 30 minutes in their store yesterday to the sales guy, their customer services etc all refusing to acknowledge consumer rights protection and their policy is it has to be repaired again! So it's off for another repair and if this fails I'll have to start being less polite I think.

    They can repair it as many times as deemed fit. A replacement doesn’t need to be offered.
    I spent 25 years in the mobile industry, from 1994 to 2019. Worked for indies as well as the big networks, in their stores also in contact centres. I also hold a degree in telecoms engineering so I like to think I know what I’m talking about 😂

    After one failed attempt at repair you have the right to ask for a refund though.

    Remember the goods are more than six months old. So the OP would need to prove the fault was there at time of sale. Otherwise no right to reject goods and retailer can repair or offer partial refund.

  • It's back by the way and 4 days later same thing, AGAIN! turned off and on again and worked, for 24 hours, turned off and on again and worked again and EE via twitter have told me to turn off carrier settings, find another network, leave for 5 mins, turn off and on again, back onto the ee network and it should be fine.
    Guess what, the triangle is back AGAIN, now phone has no service again! There must be something I can do for a less than 18 month old phone that im paying nearly 70 quid a month for that has a fault like this! It's ridiculous!

    Did you get a report showing the phone has an inherent fault etc? (See above) If not then you’ve not got a very strong position with EE. 
  • The report states the antenna is at fault thats all.
