If I wasbuying run of the mill frozen produce from Iceland and it only had a couple of months left I'd let it slide. But we're buying from a premium butcher (not cheap!) I do expect the quality/duration of the product to last much longer

It doesn’t change the reality that some meat is seasonal, for example Spring lamb (and the cuts that are taken from it) and venison.  My dad gets a lamb jointed and ready to freeze from his best friend every year, we can date when it’s ready as he lives off what’s left of the previous lamb for about a month beforehand.

It's possible that they had some product in storage that wasn't rotated correctly, or buried behind something else. It happens. But this doesn't materially impact the consumer. If it was a month or less then you're approaching unreasonable territory. Unless of course there is a some kind of guaranteed shelf life indication upon purchase.

    From their own website:

Most foods, particularly raw cuts of beef like steaks, will not instantly become unsafe to eat after the ‘best before’ date, but they may start to deteriorate a little in quality – for instance, the flavour and texture may not be at their optimum.

Goods may have to be returned by the Buyer to the Supplier within the best before date or use by date on the product.

Mmmmm, think i may go back to them - i'm not happy tbh.

I agree, i'm 4 months to the BB date, however, that is instead of the 12 months we usually receive. The items were intended to be used over the course of this year, not within 4 months.

Is this a wind up? Username suggestive of not in the real world

If not, then butcher is right and buyer is wrong. You cannot realistically expect to get the newest or most long lasting stock all the time.

Quoting out of context there, the two paragraphs are not linked but from different sections.

Your last sentence only applies where a claim for defect or damage is made !

9.2. Where a claim of defect or damage is made, the Goods may have to be returned by the Buyer to the Supplier within the best before date or use by date on the product. The Buyer shall be entitled to a replacement or a full refund (including delivery costs) plus any return postal charges if the Goods are in fact defective and/or need to be returned.

I still do not think you have a claim against DR under that section.

That's up to you to manage, not them. You're not buying wholesale. I appreciate that it's closer than you are used to, but 4 months is still eminently reasonable for the supply of frozen product, direct to the consumer.

I'm not claiming anything. I'm just saying that their own websites requires the product to be in date if you have any issues. Also that the product is not at it's best after the best before date.

DR isn't cheap, the items they sent to me have been in their freezers for several months - you pay premium, you do expect a premium product. This isn't an Iceland pizza - lol.
