Parking eye- lease car

Hi, I received a letter from parking eye dated 13/01/2023 for allegedly using their car park which is a service yard. The date of the "offense" was 14/12/2022. Ive since appealed through popla and been sent all parking eyes correspondence to date. 

It appears my lease company gave them all my information including the lease agreements and contracts etc on the 22/12/2022. (Its a personal lease through the company via salary sacrifice basically)S o first question, does the 14 days still apply if they then didn't issue until the 13/01/23. Are they supposed to send all those details? there's a lot of personal stuff, salaries, phone numbers, emails etc. IS this GDPR compliant?

Next is the fact they assume the car was parked in the car park. The ANPR camera is at the entrance, the vehicle was on the access ramp leading up to the car park so not in the car park. There's no signs on this ramp only when you get passed the ANPR camera, it was pitch black and there's no lighting too.  Basically the camera has taken a picture of the car driving up and then down the ramp-no doubt detects movement. But obviously at no point is there any image of the car parked.

Im currently trying to write the appeal to the response based on what parking eye have sent so far. Any help is appreciated. always tricky these things.

    Have you abandoned the thread you started yesterday?

    Suggest you read the NEWBIES thread to understand how to appeal. There are three template appeals for lease/hire cars there - just pick the appropriate one.

    Where exactly is this car park?

    Yep, started it in here instead as suggested. Ive looked in the newbies thread-used before but not finding answers specifically 

    Car park is at the castle view shopping centre, south wales, its basically behind the shops and passed the loading bays.

    It isn't an 'appeal to the response'. It's comments on the evidence pack.

    Wow.  Salaries? What exactly did the lease firm send and has ParkingEye put it all in their evidence pack and shared it unredacted with POPLA?!

    I bet it wasn't enclosed with your NTH?

    Ill look again but reading through i couldn't see anything directly related. 

    So parking eye in their response to the popla appeal included copies of the car order from the manufacturer which has delivery address, costs etc, my confirmation of delivery and signatures, licence plate details and vin. The Gov.uk registration, the quote and agreement which has my salary sacrifice amount, my salary P11D, my driving licence number, company directors signatures etc and breakdown of all correspondence that was under sign able. Nothing redacted.

    And nope nothing in the notice to keeper just the standard letter demanding payment.

    OK, so we know they DIDN'T enclose them in the PCN sent to you, but are the documents provided the two documents that para 13 and 14 of the POFA Schedule 4 says have to accompany a NTH?

    I think there might be a couple things they didnt do. They only initially contact the lease company by email not post for one. Im not clear on the 21 day rule either as to when that starts

    ok so under 13 and 14 yes it seams they sent the parking charge notice which has all the parts referenced and from what i can understand seams correct.
