Oven defective 4months after purchasecan I Get a replacement?

I purchased an electric oven four months ago it has malfunctioned and keeps tripping the circuit and stops working. Hotpoint whirlpool sent out an engineer to fix it into warranty but the repair failed. This was after two week wait for attendance to the issue. Had another 2 1/2 week weight and the engineer failed to complete keep the appointment. I think the oven has had it anyway would I be able to insist on a replacement or refund as it is only four months old. We are also very concerned about the ongoing safety of the device as we have a two year old trotting around the place. Any experience or advice would be appreciated

  • Your consumer rights are against the people who sold you the appliance, not the manufacturer.

    Have you reported the fault to the seller?

    Basically, within the first six months you are entitled to one attempt at a repair or replacement - at the option of the seller.  If that repair or replacement fails, you can claim a full refund from the seller.

    Retailer is Currys bought it 3 and a half months ago- I called them first and was told to go to Indesit for manufacturers warranty.  Over two week wait for appointment engineer dais head had fixed - next day it broke again. Another wait of two and a half weeks and although appoint was arranged no engineer has shown up. Call centre says it may be another few weeks for another appointment.  this will be nearly 7 weeks without a grill or oven.  Could I still chase curries legally?

    Currys do not have to abide by any consumer rights legislation.


    At least that is what their staff are led to believe! So you will have to be very firm with Currys and not stand for any of their nonsense if they try to deny you your rights as a consumer
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales
  • If you initially reported it to Currys, and it was Currys who chose to refer you to Indesit, then I think that that should count as Currys one permitted attempt at a repair or replacement.

    As Currys one attempt has failed, I would argue that you are entitled to a full refund from them.

    Yes from me too, Curry's referred you to Indesit to repair on there behalf 
    Tell Curry's you want a refund as they've attempted repair unsuccessfully

    Thanks for the advice. I'll push back at Currys. For a refund. If they won't abide with the rules I am minded to tell them I will be turning up in their Cardiff superstore on Saturday with the oven and not leave without a refund. At the same time handing random customers a leaflet with the consumer law printed on it and advise them not  buy because curry ignore consumer law

    Yeah, that's not a great idea.

    Probably not but in situations like these it takes a day or so for my emotional intelligence  to get control
