Sorry, from Debt Recovery Plus. Do they discontinue before hearings too?
@wooky_ you seem to be confused. No debt collector, not even DCBL or Debt Recovery Plus can take you to court. They are a third party that has nothing to do with the alleged breach of contract between the driver and the PPC. All they can do is write scary letters in the hope that a gullible victim will poop their pants and pay up.

They offer their services to the PPC on a no-win, no-fee basis. If they win, because the victim capitulates and hands over their money like a fool, they get a chunk of the extra £60-£70 that they added to the original PCN as they will have "won". However, if the victim is not so gullible, like most of the people who eventually discover this forum and follow the advice, they will eventually go back to the PPC and admit failure, thus leaving the PPC with the option of progressing it to a court claim or giving up and fishing for other, more gullible prey.

So, forget about any debt collector letters. They are best used as kindling or lining the bottom of a bird cage. What you are waiting for is an LoC. That's when you sit up and take notice as advised in the Newbies/FAQ thread which is your go-to reference every time you have a question.

Haha!  Obviously we always ignore DRPlus!

You really need to read the fourth post of the NEWBIES thread if you were thinking of paying the likes of DRPlus and/or thought they can file court claims.  They aren't solicitors.

@wooky_ You need to sit tight and do some reading of the following thread. You're not there yet, but should all things DCBL follow the usual pattern, you will be more ready to deal with them with some better knowledge based on your own reading and research.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thanks for all your advice 🙏❤️ Is the attached (redacted) letter worth more notice and attention than the letters from Debt Recovery Plus?

    Nope!

And while your case is quiet this Summer... photos please!  From friends & family too!

... we sincerely hope that you are au fait with the need to respond to the private parking draft Impact Assessment by mid-September?

Or let me do a submission containing YOUR photo evidence please...

You want to help us change the law?

To be clear, we are nearly there; it's not a petition or some weak campaign, it's a final push on a law already passed, to cap the £PCN levels and ban the fake DRA fees.

The Government has a Call for Evidence open right now.

We are wanting photos of unmanaged car parks, Hospital car park signs near you that show £50 or £60 as the deterrent, and Aldi, Asda, Tesco or Sainsburys £70 signs please.

    All discussed here:
    https://forums.moneysavingexpert.com/discussion/6463361/dluhc-private-parking-code-government-launches-call-for-evidence-discussion-thread/p6

We need photo evidence of low or no deterrent car parks near you, please!  Think of this when out for a walk or driving to a car park that is unmanaged or has PCN signs of £70 or lower.

NOT £100, NOT £90 or £80.  Just signs that are less - or places with no PPC.  You will see examples of what to post, in the latest pages of that thread.

    Thankyou!

    Short answer... No.

If you carefully read the letter, they have been "instructed" by DRP. DRP is not a party to the contract you allegedly broke with UKPS Ltd and therefore cannot do anything, whatsoever, about it except to try and con you into paying something that you won't have to pay.

If/when you receive a real LoC, come back and show us. Anything that is not from the UKPS Ltd or one of the robo-claim solicitors such as DCB Legal, Galdstones or BW Legal, to name a few, is not worth the paper it is written on.

Do a simple Google search on "pre-action protocol" to see what an LoC has to include.
