UK Parking Administration Ltd & Trace Deb Recovery - PCN received

Hi All,

I've had some bad luck of recent with PCN's and after a lot of reading on on the forum I've decided its time to reach out to the experts.
Before starting a new thread, I read through the Newbies section and also searched threads to find similar scenarios in an attempt to arm myself with some knowledge, but its a minefield and I apologise in advance mis-interpreted any or not quite followed it!

I have received a PCN, as the registered keeper, from UK Parking Administration ltd, issue date 11/01/23 - I didn't actually receive it until around the 10/2/23 ( I know it was after the reduced payment period dated 8/2/23). At this point I didn't come to the forum, I appealed via their website as the letter says, as I felt it was unfair that I had missed the discounted rate period due to no fault of my own, more than likely due to royal mail strikes. £60 was the reduced rate, £100 once 14 days had lapsed.

I have no 'proof' that I appealed through the website, no email confirmation etc and I have had no reply. 
Today I received a demand for outstanding payment from trace debt recovery for £170.

Should I appeal to UKPA using the appeal template in the Newbies thread? or is it too late now? I'm slightly confused with all of the thread reading. I also cant find any thread directly relating to UKPA of recent, some from years ago but after checking companies house there is a dissolved company using the same name, the new one formed August 2021.

In the midst of all of this, I received a letter of claim from UK parking control ltd for an old PCN dating back to 2021 from UK Parking Control. I'm not too concerned about this just yet as I've spoken to the car parking management and they are requesting this to be cancelled, but reading through threads relating to this has further confused me!

    No need to be sorry. You've come to the right place. It's just a pity you weren't here before you appealed. Did you reveal the identity of the driver? It may make a difference in how you defend the scam.

    Where was the parking event? Can you show us the PCN suitably redacted? Is it POFA compliant?

    All these issues are in the Newbies thread which you may have to read and study several times but you will get advice and it will become clearer once you have a better understanding of the process.

    IMHO the industry is rogue - truly rotten -  and they are desperate because they are facing a robust regulatory regime next year that some of the hangers-on won't come out the other side of, and they know it.

    Also, whilst it quotes POFA and uses most of the wording, there is an error where they advise "29 days" instead of the required "28 days". It may be inconsequential, however, if it ever got to court, it may be worth highlighting as not being quite POFA compliant.

    If that was the case, it would also depend on how compos mentis the judge on the day is.

    Afternoon All,

    I have recently heard back from the shopping park regarding the first PCN received, and unfortunately they've stated its too far into the process for them to cancel it.

    I've attached a copy of the letter of claim from DCB Legal and read the newbies section again, i just wanted to check if anyone had any further advice before submitting the SAR.

    It isn't too far along the process to cancel it. They are either lying or have accepted UKPC's drivel.

    Reply robustly.  Tell them to step in and just cancel it or you want the name of their staff member who will be called to court to explain why they sat on their hands and did not, given UKPC is only their agent and the managing agents/landowner (as principal) remains liable under the law of agency.

    Will do, although the person who has responded to my emails stated at the start that they dont directly deal with the parking, but had passed it on and had a reply from said person.

    Ill keep an eye out for a reply, but conscious that the LOC is dated 20/2 and Ive got 30 days to respond to it. May have to just SAR. How late can I leave it to do this?

    There is no rush for a Subject Access Request.
    The information returned will be of far more use at Witness Statement time - some months away.
    Having said that, send it as soon as you like.
