Dcb legal letter of claim in partners name, can I fight it?

    You can’t do anything in his name, except bluff and hope.

    Just ask him to transfer keeper liability to you, the driver.

    Then it’s game on - we are ready and waiting.

    Can I contact UKPC and ask them to put in my name as the driver at the time and now the registered keeper of car?
    Nope.

    But the keeper can and should.

    THIS IS EASY!  The keeper writes or emails DCBLegal (if the LBC is from them) to transfer liabilty to the driver and gives your name and postal address.

    Then they have to write to you instead.  You should then respond and say you were the driver but did not leave the site.  Ask for evidence.  They won't have any...

    The claim you will then get is so simple to defend and see off that there won't even be a hearing.

    so for now shall we just get the liability transferred to myself ? And not do anything around the SAR, deny letter….

    Yes i was the driver.

    I did not leave the site and you and I both know your client has no evidence.

    By all means crack on with wasting your money on a court claim, then later discontinue as you always do when you see a MSE defence and the victim doesn't blink.

    Or jog on.  Your choice.
