Parking Eye appeal

I just appealed online against a parking charge for a car park over 200 miles from home.  Totally new experience for me!  I could not possibly have been there, as I can prove by my mileage records/petrol receipts.  And whilst the number plate appears to be mine I suspect one or possibly 2 letters have been misread due to the positioning of fixing screws.  Or my plate has been cloned.

However the biggest mistake is their photo is of a light coloured car of the same manufacturer as mine but a different model and is light coloured whereas as mine is dark green.  I have submitted all the supporting evidence - photos of car, mileage readout, petrol receipts etc so am confident this notice will get withdrawn.  But in such a case has anyone any experience of how long it might take to get this overthrown?  And should I contact DVLA in case my registration on my 20 year old car has been cloned?

  • After checking the possible variations on my reg plate I found the culprit who should have got my ticket.  A make/model/colour that is quite clearly the one in the photograph.  The actual letter C has read like a G (as per my car) thanks to the dodgy position of the plate fixing screw.  So is not a clone. Phew!  But had Parkingeye checked the model and colour of the offending car they would have realised their mistake without wasting everyone's time

    Complain to the landowner, the BPA, the DVLA, and your MP about this data breach.

    Did you actually appeal to PE using their appeal portal, or did you send an appeal or a complaint to PE by email?

    PE say that they carry out a 19 point check of all ANPR scamera images, but they have either failed to do this or the person who checked it urgently needs their eyes testing.

  • I appealed via their online portal and I am initially also writing to DVLA regarding a breach of personal data security. Once I found the vehicle who should have got the PCN I sent an additional message via the portal to PE & expressed my anger at this sloppy action.  I got the automated "we have received your appeal" responses.  When they do respond properly they will be getting an invoice from me for my wasted time, the postage to appropriate DVLA dept which is only contactable by snail mail and a expectation of compensation for their action in wrongly pursuing me. 

    I won't give vehicle details here but a comparison would be me driving a dark green old style mini with the photographic evidence being a white VW Beetle!

    What's the bet that the PPC will just ignore everything you have evidenced and disallow your appeal?

    Not that you are wrong, but these scammers tend to just robotically dish out these PCNs in the hope that the victims just pay up without a fight.

    Anyway, what are the odds?
  • The photographs of the parked car are so clearly not mine and the fact that I have identified that car where they failed makes me 100% sure that they don't have a leg to stand on.  So they can take it where they like but I will not be paying anything.  The thought that I could have spent the whole of a day (7:30am to early evening) in a car park 200 miles from home is laughable.  I would not expect my ancient car to take ancient me on such a long journey these days.  I rarely do more than the 3 mile round trip to Tesco these days.

    Another ANPR fail these systems are not fit for purpose which is why local authorities cannot use them, but the government allow a scammers' industry to carry on regardless.

  • In my letter to DVLA I have pointed out that due to the fixing of the number plate making this mistake possible the plate probably does not conform to legal requirements. A faulty plate is supposed to be picked up by the MOT test - one of mine caused a fail a few years back due to no longer being 100% clear thanks to delamination.

    My concern, also expressed in my letter, is that due to the sloppy system of PE & possibly others, I could actually be fortunate that this mistake has only happened once in 20 years.  Am I now at risk of further PCNs, speeding tickets, or other false accusations if this rogue vehicle flouts the law in any way?

    I'd be more angry with ParkingEye.  Not the other vehicle.  ParkingEye enhanced images from an unfocussed ANPR camera (or in the dark?) and it is their photoshopping - or similar software -  that enhanced it with guesswork to look like your numberplate.

  • My car is a small city car type.  On a closer zoomed in look on my large PC screen at PEs photos which are more detailed & clearer than the ones reproduced in their letter  they are of a van, complete with roof rack & some sort of ladder attached.  I am most definitely most angry with PE.  But I am more than happy to stir any pot connected to this farce be it DVLA, the car park owner or White Van Man who allegedly parked for over 9 hours in a 3 hour limit.  Going by entry & exit times he was probably working nearby all day.  If the PCN charge is valid it his his debt not mine.
