Wine Subscriptions and Distance Selling

Simple question. Have you asked the company to cancel and if so, what have they said?0

- It is different wine each time.
- I did not restart the subscription, it automatically restarts after you miss the month, and you have to remember to pause it again.
- This is actually for a different amount of bottles at a different price, so is it the same subscription?
Also, usually you can refuse a parcel when it is delivered, and ask them to return it to sender. Could I do that if I am actually home?
Though the courier is Hermes or Evri (bit as bad as Hermes) so do they even allow you to refuse, if you get to them before they dump it and leg it?
(6) If the contract is a sales contract for regular delivery of goods during a defined period of more than one day, the cancellation period ends at the end of 14 days after the day on which the first of the goods come into the physical possession of
It doesnt state the regular delivery has to be for the identical goods each time nor that the value of goods has to be the same.
I've not looked at their website to see their exact terms or language used but it sounds like you have a contract for a monthly supply of wine however have the ability to skip months (sounds a more relevant term than "freeze")
You can refuse delivery but that doesnt mean you are entitled to a refund, you then just are paying for goods that you dont receive. It wouldnt be unreasonable for the company to charge a redelivery fee if you refuse delivery, they refuse a refund and you then change your mind.
Really though this is best dealt with by speaking to the company and being apologetic about not having given the instruction to skip a month in time and talk through the options. We have seen many long debates on this site about the legalities of what can and cant be done and irrespective of the statutory rights the company have been reasonable and said something can be returned etc without fuss.3 -

That will all be covered in their T/C.
Or you would have to go through the sign up process each time. Providing your payment details etc.Life in the slow lane1 -

Yes, you don't get an email every month warning of the £20 debit but, unless you have also specifically signed up for a regular case, neither do you get a delivery every month.
I have been with Naked Wines for years. I pay £20 every month by direct debit. I order wine whenever I feel like it using any credit balance topped up by a credit card payment if required.
Naked Wines are very good. A few years ago I found I had run up a credit balance of about £140 and didn't need any more wine for a while. They happily refunded me that £140.
Last year I did sign up for a case of selected wines every 3 months. I received the first one. I had plenty of warning about the second one which I declined.
Sadly I have just closed my account with them as I had Covid in September and I now have Long Covid which has badly affected my sense of taste so I rarely drink wine anymore.
I have gone from about 5 bottles a week to virtually none. I now drink cider instead.
Hopefully I will get my taste back again sometime. I will rejoin Naked Wines if I do.
A man walked into a car showroom.
He said to the salesman, “My wife would like to talk to you about the Volkswagen Golf in the showroom window.”
Salesman said, “We haven't got a Volkswagen Golf in the showroom window.”
The man replied, “You have now mate".2 -
We bought some items from Harts of Stur a couple of months ago. On the HoS site they promoted three free bottles from Wine52, for a certain minimum spend with HoS, just pay the carriage of around £7.50
Sounded good so we did that, the wines arrives as promised and was a smooth transaction
Imagine my surprise (as they say in Viz) when I had an email last Friday telling me my next consignment of wines was on the way
My fault to an extent, as there was something about a sub in *very* small print on the promo page, but you' d have to be in the know and looking very closely to see it (dwarfed by the words FREE WINES)
Anyway, phone them this morning and cancelled the sub (although would accept the delivery expected today) - got through quite quickly and wasn't deflected by the sales flannel. I'll prob ask the bank to block any future payments to this company, although was assured this wasn't necessary
Lots of complaints about this company's "sharp practice" online0 -
