I have spoken to the County Court Business Centre this morning - they have my defence!! Ah the frustration that they have now magically found my defence (for which they issued me a CCJ for!) is beyond belief! They have confirmed that the defence is sent to the solicitors and they have 33 days to decide whether to proceed.

Clearly easier to say it is missing/not sent than it is to look diligently for it.  Anyway, good news for you.

    An Update:

I've received a letter from DCBLegal to state they wish to proceed with the claim. It reports that the court will direct both parties directions questionnaires.

Is there anything I need to do at this point, or just wait for the directions?

Do exactly what it tells you to do in the Newbies/FAQ thread and follow the 12-point checklist from the Template thread.

All the information is there. Just use those two items as your reference if you have a question. Come back if there is no answer to your question.

This is covered in the Template Defence thread.

I called the CCB yesterday to chase an update on this. They reported that as DCB legal haven't responded within the 33 days, this is now closed in their eyes (the lady did give me the technical term but I can't remember it), unless DCB legal pay the fee to continue with the case. I thought this was unusual, given that DCB sent me a letter with the General Directions they had submitted.

    It is currently Stayed.

But they WILL un-stay it soon.

Could be as simple as the CCBC having missed an email from DCBLegal in which case they won't even pay a fee. Given the CCBC are 5 weeks behind on post & emails, I'd say this is due to CCBC oversight.

You were right - I have the general directions through. I will fill them out as per recommendations.

    2 questions

How do I find out where to send them to for the claimant? It's UK Parking Control LTD
Can I use the CCBC email address to submit them?

You send a copy to their solicitor, not to UKPC. I'm assuming they are using DCB Legal so when you send your N180 DQ to the ccbcac email address you used for your defence, you CC in DCB Legal and also bcc in yourself just to make sure that the email is received. I think info@dcblegal.co.uk or .com will get to them.

It says on your Claim Form; the address for documents is obviously via the solicitor. That's why UKPC are using them.

The Template Defence thread says that you email your DQ, if that's what you mean by 'them'.  That sticky thread explains all the first stages and where to email that form.
