Thanks for this - will amend accordingly as per your advice. Would it be worth including the DVLA in the email along with my local MP or contact them separately, do you think?

Yes, this was stated in the email that I sent twice that was ignored (copied myself in so it definitely was sent). The only way I've managed to speak to the shopping centre was by phone.

Do separate complaints to the BPA, DVLA and your MP. I have found this site useful for the latter.

WriteToThem - Email your Councillor, MP, MSP, MS, MLA or London Assembly Member for free

If/when the DVLA fob you off, report them to the ICO for the data breaches.

  • Have you considered sending a SAR off to the Parking Firm and DEMANDING them to show you what PROOF they have of you "parking in a child/parent bay without children" present. They won't have any and would be pretty stupid to try and push it to court with no proof.

Did you complain to the BPA? You should, and ask why the parking company's attendant isn't paying attention to a person or persons unknown who is removing NTDs after she or he has affixed them.

And include a second complaint, that the operator is appearing to make 'naming the driver' a condition of appealing.  This is something the BPA and DVLA forbid and have said in the past, is to be treated as a severe breach of the Code.

UPDATE: Appeal was sent with amends as suggested. Just received an email response saying that the appeal has been rejected.

Essentially because ''The operative on duty observed the vehicle being parked at this location and then witnessed
the driver exit the vehicle, without a child being present.''

As expected at first stage appeal, but you already know that from the NEWBIES thread, snd what to do next.

So... what if you were there to collect your child from somewhere or someone inside? Anyway, the "operative" lied as there was a "child" present... surely the driver is someone's "child"?  >:)
