Air Europa delay part 2

A couple of months ago, I posted on this forum about claiming against Air Europa because of a 3 hour delay on a flight home from Madrid due to maintenance issues with the plane’s toilet. They have refused the claim saying the toilet maintenance was an extraordinary circumstance’. Two very helpful people answered and of course confirmed that was wrong, and one very helpfully provided links to cases where the same had been argued and won. I went back to Air Europa with these and they again came back with an unchanged opinion because they believe : “we have not found any argument that could possibly question our initial response.”

 I would like to take the next step, which i believed to be the European Small claims form, but when I selected UK a for address I got this pop up message :


My flight was in July 2022, so I don’t think I can use this form. Please can someone confirm if this is correct? Also, if I can’t, which is most likely, how can we make claims against European air carriers from the UK now we’ve fully brexited?

Also, the flight was me and my husband and kids so I also would like to know if that’s 1 claim form each or if we can claim on the 1 form together?

Any help would be much appreciated.
