Help with M&S refund

Hi. I have an item of clothing to return which is just outside the 35 day window. The store won’t help. If it’s a gift why won’t they exchange the item or give a credit does anyone know? Ive complained and they won’t budge. Thank you.

    You've answered your own question.

They won't exchange because you are outside the 35 day window.

Why do you want to return it?

If its because its faulty the answer is very different to if the gift recipient just didn't like it or it didn't fit etc

As above, if it’s a change of mind then there’s no obligation on them to do any sort of refund or exchange in any timescale for an in-store purchase. Online purchase has the usual 30 day  return.
Those are the rules they’ve chosen to apply and that’s what you have to accept. They’re not going to change their minds - Parent had similar because she didn’t realise their policy had changed and she did follow it up with customer services but it didn’t make any difference. The return by date is on the receipt.

All shall be well, and all shall be well, and all manner of things shall be well.

Pedant alert - it's could have, not could of.
  • Do M&S still allow you to return items without a receipt? I did it once a number of years ago - obviously just got a gift voucher but that suited me okay as I tend to shop there quite a lot.

  • Because that’s their policy. How long do you think they should give customers to return? 36 days? 37? 38?

You have no statutory rights to return anything purchased in store, so you’re relying completely on goodwill.

Thank you. It didn’t fit.  I thought that if you returned an item without a receipt and it still had tags and was current stock that you could have an exchange or credit to the current value.  I was trying to find out if that’s still the case so I could at least do that.

Nope. that's a very old shoplifters trick. Not that i'm implying you are, but you can see why shops would require a receipt for instore purchases.

    What question are you asking?

Are you asking (1) whether you can still return something outside the 35 day return time limit, or (2) whether you can return a gift item without a receipt?

If (1) then no, you can't do so unless they allow you to.  They put a 35 day limit on their returns policy so if you are over 35 days they can refuse you.

If (2) it appears you can do so and you will get get a "credit receipt" at the most recent price, valid for 12 months.  But I presume you would still need to return it within 35 days.

Re question 2. How would they know if I was returning within the 35 day period if I did not have a receipt?

That is not a daft question.  That's a very good question!

They say you can return items for up to 35 days, but they also say: "For gift returns, exchanges or returns with no proof of purchase, you’ll get a credit receipt at the most recent price(s), valid for 12 months".

If there is no proof of purchase I have no idea how they would know whether it was bought 20 days ago or 50...
