    Was it a typical garden wooden shed delivered as 2 side panels, two end panels, a floor and two apex roof panels

    If so, I agree that would be hard to steal! 

    Or was it one of those 'plastic' self-assembly sheds where everything just slots together and it comes as a 6ft x 2ft parcel ?
  • Not many delivery companies deliver big stuff like that (and I work for one of them) which is why I was curious who the company was. Standard practice with something really big is make sure someone is going to accept delivery before you struggle off the van with it. We sometimes get 90Kg rolls of artificial grass etc and one person (the driver) is expected to unload it himself.

    This doesn't read to me like the OP lying 

    OP has said he doesn't know when it was stolen (if delivered) just from that time of delivery there was a six hour window between him coming home from work.

    I had a shed delivered in parts previously and we were here to take delivery BUT the whole thing with the company was an issue and a part was missing.

    They had to deliver that on a different day but failed to turn up when they said they would and subsequently I wasn't home when they did turn up unannounced. They too left it in my garden for me to find when I returned home.

    It does however seem odd OP doesn't want a replacement.
  • 1.  Why does anybody assume the OP is lying?  If you're going to proceed from that assumption there's not really much point in replying to any thread as you could never be sure any comments you make would apply as you wouldn't be able to trust what the OP said.  I take posters at face value and assume they have the intelligence to realise that if they don't tell the truth then any "advice" they receive here will be of little if any value.

    2.  And what's the issue with them wanting a refund as opposed to a replacement?  Why is that relevant?  If the answer is that it reinforces the notion that the OP might be telling porkies, then I refer posters to the last sentence in 1. above.



    Regarding a refund or replacement, what I will say is that looking at the legislation again it's not clear to me what remedy (if any) a consumer can insist on where goods "go missing" before delivery into their physical possession.  The legislation doesn't explicitly say that the consumer can insist on a refund, but if I were the OP I'd be asking for a full refund if that was what I wanted.

    If the OP gets a refund, fine.  End of story.

    However, if the supplier accepts responsibility for the goods "going missing", but insists on providing a replacement rather than a refund, then the OP might need to consider cancelling the order or withdrawing their offer to buy.  (Although if cancelling the order it's possible they might end up paying return costs unless s35(1)(b) or s35(5) The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (legislation.gov.uk) apply).

    But no doubt the OP will return and ask for further suggestions if they get no satisfaction from the seller...

    In all honesty I thought it sounded suspicious as well but took the OP at their word. It’s not easy to steal a shed and it’s logically something the OP will still want so most people would want a replacement.

    Ultimately it makes no difference to their consumer rights. Were I the retailer though I’d assume they came home, found it in their front garden and as they hadn’t signed for it thought they could get a free shed. As such I’d go through this case in as much detail as possible before I refunded. It’s also worth noting if the OP had done this (not saying this have) it would be fraud and they could potentially receive a criminal record for it.

    However if they did actually receive it I’m not sure why they’re posting on here either.

    I don't believe the OP in this case is lying, but I do come across some threads where I think the poster is dishonest and is using the forum to rehearse their argument with the retailer/courier, etc.

    I agree to take posters on face value also OP said "After a few to and fro from onbuy I have asked for a full refund" so it seems it seems there was some discussion, if that discussion left little prospect of the goods being not being replaced it's understandable to then request a refund.
