@Boat_to_Bolivia hi bud,
Just received another phone call from them with another voicemail. Reckon it’s worth sending an email asking them to email instead so it’s all written down?0 -
@Boat_to_Bolivia @Coupon-mad

I love how their balance is £305. It was £170 before they applied for a CCJ at CBCC 😂😂😂1

Just to add I’ve received paperwork for a court date in June which is probably I’m guessing why they are offering a settlement. Will wait for your advice what to do0

No probs. I just don't want DCBL to bring up in court that they offered to settle and I ignored and it look bad on my case. I was quite looking forward to having the satisfaction of declining and telling them I'll see them in court! No problem.
The court date is for June 16th which is when I'm on holiday. I noticed they say that this will take place in my absence which I'm a little concerned about. Is there anyway I can request to have the case moved to a different date?
It has stated the claimaint has to pay the court the trial fee by 19th May 2023 otherwise the claim will be struck out.
In regards to WS - it states ''The Claimant must send the documents so that they are received by no later than 4pm on 22 May 2023. The defendant must send the documents so that they are received by no later than 4pm on 5th June 2023 so 5th of June looks the date and I don't want DCBL legal trying to short me last minute like they did with my CCJ case. I was absolutely furious that DCBL stitched me up that way so I will be submitting document asap.
Is it also worth my partner doing a WS and she was with me on the day? It says about any supporting WS on the court documents.
So I've got my defence draft that I submitted to the court upon the hearing of the CCJ that DCBL struck out last minute and the judge refused to look at but did say if I was happy moving forward with it to the small claims court.
Apart from the WS and the defence draft i've already got; do i need anything else?
Hoping the courts will move the date as I want to be there not in absence!0 -
DCBLegal don't proceed to hearings.Refuse to settle when they phone you, and wait and see if they meet their 22nd May deadline. They won't. They'll discontinue if you refuse to settle.
DO NOT MISS YOUR 5th JUNE DEADLINE.
BUT DON'T DO IT EARLY.
They will discontinue if you do everything right.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

With those instructions, I would not be filing and serving my Witness Statement and evidence as soon as possible.63realfan said:In regards to WS - it states ''The Claimant must send the documents so that they are received by no later than 4pm on 22 May 2023. A clued up judge has given you a filing deadline two weeks after the Claimant's deadline.
If they don't discontinue, that gives you two whole weeks to find all the holes in their case.
Don't throw that away.
Also be ready to report the Claimant's failure to meet that 22nd May deadline should that happen.4 -
Thank you. I see now, appreciate it! Is it worth replying to their email “no” 🤣Coupon-mad said:DCBLegal don't proceed to hearings.Refuse to settle when they phone you, and wait and see if they meet their 22nd May deadline. They won't. They'll discontinue if you refuse to settle.

Did you not have the opportunity to provide the court with dates you would be unavailable when you completed your N180 DQ? Whilst we fully expect DCB Legal to discontinue before it ever gets to court, if it did and you were not there in attendance, you would be at a disadvantage. I don't believe you now have any opportunity to get the date moved.63realfan said:
