Hearing finished.... Unfortunately things did not go my way...
Judge did not accept the fact that I communicated with UKCPM and Gladstones and told them about my address many times before. He said that because the address with DVLA was not updated and because I did not respond to Gladstone's letters, he would not strike out the claim. He said it was my responsibility to have it updated, because of that the result is a set aside. He obviously did not give me the right to get the £275 from the claimant...
He also said he was not bound by what the judge in CEL V CHAN decided...
The claimant now has 14 days to present a new claim and I'll have 28 days to defend....
Another discussion was that in this claim there was 5 PCNs, 3 of them for my motorcycle... He said that I also need a permit on my motorcycle... They do noy even have windscreen I told him, he said "lets not grt too technical"... I also told the judge that is unrealistic to have a permit there and it would get stolen, he didnt care much about that.
So yeah.... I'm pretty much screwed at this point... I can't defend against a permit having fallen off of my windscreen.
To top it all off, the Judge said he didn't see much prospect in me defending this case, as the contract says that I have to display a permit at all times...
Don't really know what to do... Most likely will have to pay all PCNs... 18 of them, equating to more than £4k....1 -
I don't think you are bound to lose but I do think approach Contestor Legal.
I reckon they can potentially rescue the case at the next hearing. For the amount of money at stake - £4k - it must be worth their fee.
Do that this week. They will want to see all paperwork and read your account of this set aside hearing and what was said. None of us here are connected to that firm.
They are the ones who achieved CEL v Chan and turned that set aside case around.

Would they be able to somehow bring the other PCNs that are outside of this claim, into it? Like dealing with everything at the same time? Because right now in this claim there is only 5 PCNs...0

No. That's a good thing because if you can get help to win this one (and maybe even set aside that Judge's Order if Contestor Legal think there are grounds) then it's easier to defend the others if they try another claim.
Separately:
Have you told the parking firm & their agents to ERASE THE OLD ADDRESS in relation to those PCNs which have not been claimed yet? YOU MUST. You can't leave them with a choice of 2 addresses for ant PCN at all.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

You don't RING parking firms or Gladstones and certainly not with something so important as erasing an old address. Especially not just after that first court hearing!
This is not done over the phone.

Time for an update. I emailed UKCPM and Gladstones to drop my old address and update everything with my current address. UKCPM responded with the following:
Gladstones have not responded at all yet.
I have spoken to Contestor Legal, and they are happy to take my case. Now their price is £80 per PCN, to a total of £1440... still a lot of money. This would be to deal with the total of 18 PCNs. Needless to say that this is still a lot of money which I don't have right now, but they are happy to facilitate the payments.
Second option, is to handle the current 5 PCNs in this claim, I pay £400 and have them help me handle this case. Doing this, might get UKCPM to drop all of the PCNs, so this way I wouldn't have to pay for the whole lot. Now, if they were to do more claims with other PCNs, Contestor Legal would be happy to help me fight those off as well, for the respective fee, obviously. But at least we would try and see if they give up on them...
I understand that most people will think "Oh just pay the £1440, its better than £4k in PCNs"... I get that, but even the £1440 is a lot of money right now...
I have a question though, can someone explain to me why did UKCPM mention that all the cases are with Debt Recovery, instead of Gladstones?0
