Parcel tampered by DPD

I purchased a Samsung s22 ultra valued at 930 on the 5th November
It was delivered and my daughter signed for it. There was a quick picture of her feet and the door opened. She then put it on the side and when i got home to open up the package i found a tape measure had been put in its place.
I reported it to Samsung and they opened up a case. After 4 hours of chasing up Samsung and over 30 emails and being told to wait 48hrs and wait 10 days ect ect they now have told me it was delivered and case closed. How can i proceed now please.

I assume you bought it directly from Samsung? Technically, they are responsible for the goods until they come into your possession. The trouble you have is proving that the phone was removed from the package before your daughter accepted delivery. If you paid by credit or debit card, speak to your card issuer for their advice. They may be able to help but I've seen plenty of posts here where the card provider accepts delivery took place so they won't intervene.0 -
I assume you have contacted the police to report the theft, got a crime number, and got Samsung to block/blacklist the phone??

I don’t understand the title of the thread. What evidence do you have that it was tampered with by the courier? Your daughter could have easily tampered with it also.1

It's now getting to the stage where you have to video the delivery man before you accept the package and continue videoing until it's been opened1 -
How did you pay for the item? You could either speak to your credit/debt card provider, or send a LBA. The theft has occurred from the retailer, as you have not taken possession of the goods.0

Sadly any chargeback would be rejected by retailer on the grounds package was delivered. If they did not, then they could still chase via courts for funds.Life in the slow lane0 -
What other evidence is there?
For example, is there a weight printed on the shipping label? If so, is it consistent with the weight of the phone?
As others have suggested, it could have been substituted before the parcel was collected by DPD.
Ultimately, if it comes to court it will be up to the judge to decide, on the balance of probabilities, whether to believe Samsung or you so any scraps of evidence in your favour will help.0 -
