Lost goods

Hi experts.
In December I purchased goods worth £150 from a shop on ebay. They were delivered to Argos for me to collect. Due to work by the time I went to collect goods, they had been returned to the seller by Argos. I was told by seller I couldn't be refunded until they got them back. They received the parcel from Argos on 12th Jan. Only the wrong parcel. Not my goods.
They are now in dispute with ebay and Argos, and refusing to refund me until they get their goods back. They are a reputable dealer usually.
My thoughts are, I didn't get my goods from them, and they should refund and claim from Argos?
Advice please.
Thank you

Surely the item was delivered though, to the Argos store the buyer chose.

I can't remember what the eBay view of it is for Click and Collect, but logically the seller has had it delivered to the address the buyer requested.  They can't then force the buyer to go and collect it.

I've always thought it was rubbish that sellers had to refund the whole lot including postage when an item is returned simply because a buyer didn't/wouldn't collect the item (especially when delivery has been attempted multiple times at the home address, not applicable in this case).

Yes. But due to work issues I couldn't collect it. When I attempted to, it had been returned to seller,  only they (Argos) returned the wrong item. A neoprene brace. Not the hydraulic dampers I'd ordered.

Seller has one ongoing. PayPal refused a refund as they were delivered to Argos. Even though I never collected them.

Were your dampers still at Argos?
A man walked into a car showroom.
He said to the salesman, “My wife would like to talk to you about the Volkswagen Golf in the showroom window.”
Salesman said, “We haven't got a Volkswagen Golf in the showroom window.”
The man replied, “You have now mate".

I've no way to find out.
  • You should still open an INR case as you haven't received any items. The issue should now be between the seller and his/her courier - nothing to do with you.

Excuse the ignorance. What is an INR case.
