ParkingEye Seed/Coporation Street car park

Received a PCN for 'Corporation Street' car park (although was in reality Seed Street Car Park). I have submitted 1st appeal with template wording, full expectation this will fail so am thinking ahead to POPLA appeal.

A few facts:
  • PCN identified wrong car park (Corporation Street does not have a car park)
  • Have appealed as registered keeper and have refused to supply driver details (as per template in NEWBIE sticky)
  • Car Park is based in England but I live in Scotland, believe this makes a court case more difficult/unlikely
  • The driver had purchased in advance parking for Hill Street Car Park, unclear signage and poor weather meant driver parked in incorrect car park (Seed Street). The street is very small and having followed signs for 'Hill Street Car Park' and seeing a car park symbol the driver parked. The road takes a 90 degree turn and the other (correct) car park is there, not visible from turning in to road. Proof of pre-purchase for Hill Street parking is available.
It is this final point I am not sure how to convey, I believe the last point makes it harder to for PE to prove a contract existed since there is a clear evidence of intent to park elsewhere.

    Do NOT try POPLA in Scotland.  Stop right there and ignore ParkingEye now.

    Consumers in Scotland cannot use POPLA safely because they (shockingly) insist on only the ADMITTED driver appealing.  Do not do that.

    Thank you - I should have paid more attention to the NEWBIE info I now see it does mention that. Will ignore unless or until Court action (Never happened before but there's always a first time).

    Ignore it completely - nothing will happen except debt demands - but be aware for FUTURE private parking charges (not this one):

    (a). Scotland is adopting the new Code of Practice in a year or so, that will also apply in England and Wales.

    (b). Scotland will also bring in 'registered keeper liability' (a bad thing for motorists) and a proper appeals service (a good thing).  The law is changing for you and us.

    So, we sincerely hope that you are au fait with the need to respond to the final Government Public Consultation?

    We anticipate it will be open very soon.

    We all need to ram the nail in the coffin of the false £70 'DRA fee' add-on, that funds the DRA gaslighting of people that you are experiencing right now.

    Whether in Scotland, England or Wales, all UK motorists should respond to make sure the level of parking charges is capped at a proportionate level AND the added £70 is banned.
