Good evening all,
Recently had a PCN for over staying in a car park managed by premier park.
They state that i was 17 minutes over the two hours allowance.
Spent a chunk of money in pc world so after getting the PCN i went back to Pc world with a copy of receipt and PCN. they took a photo copy and said they will sort it.
I said that i have the TV in the car and they can have it back but no they took photo copy of PCN.
Today have a letter saying i have failed to reply and that now they want the £100 pounds or the usual 28 days and debt collecting and maybe court.proceedings with additional costs.
they do mention in letter paragraph 9 (2) (f) of schedule 4 of the protection of freedoms act 2012 that notice given to me.so i presume that this means registered keeper liable.
anyway, when driving into car park no signs obvious as not safe to read signage while driving in and around a roundabout.
car parked but not in front of any signage and when leaving car i headed to pc world not looking at any signs just the shop.
spent 2 hours in store with store sales people deciding what tv to purchase.
got to car with tv around about the 2 hour point at which point i was maybe a few minutes over but at this point i had no idea of the time restriction, took me good few minutes loading the 55 inch tv in car.
nobody in the store ddealing with me talked or mentioned about parking times etc just selling etc.
Got first demanding letter and took it to the store who as before copied it with receipt and siad they will sort it.
so roll on now i get the letter for the full amount.
I have been on premier park and can see i can appeal but dont think i will get the popla chance.
the two photos of my car show car in motion and not even in a car park not even signs or parking spaces in view.
my question is do i go back to pc world as they wont pick up phone and again get them to tale another copy of this new letter.
do i appeal to premier park stating shop said would sort it.
or do i appeal and let them chuck me the threaty letters etc.
do we get ten minutes grace and the other 7 minutes unloading and loading the big box into the car. loading not counted as parking?
before i appeal to premier just want a few pointers and does this allow me to demand popla chance due to store taking copy stating they will sort it.

Take the TV back, ask for the manager, demand a refund and explain why. By failing to honour the (verbal?) agreement to cancel the charge they are in breach of contract so you want you money back unless the charge is cancelled.
Appeal the charge anyway stating that the landowner/landowner's agent has instructed this charge to be cancelled.
