Lease has ended but company not leaving

    You've named the company further back  in the thread. Many companies will google their name. If they see statements like that and they complain to MSE, the post and/or thread might get removed - which would be a shame.


    You've highlighted some really important points - that R2R tenancy agreements can be heavily biased against the landlord.

    When signing an agreement people often only consider the "best case scenarios" - i.e. that the rent is paid regularly, the property is looked after, etc.

    People should also consider the "worst case scenarios" before signing, for example, what if...
    • The tenant doesn't pay the rent
    • The tenant goes bankrupt
    • The property gets trashed
    • The sub-tenant is anti social
    • The sub-tenant breaches leasehold covenants
    • The sub-tenant won't move out
    etc

    I wasn't aware when I signed the agreement. 

    The rent is guaranteed paid by the company but why get £800 for 3 years when you can get £1250+ on the open market, select your tenant, get deposit, do refrencing and other checks. Don't get me wrong things can still go wrong but due diligence hekps reduce the risk. 
    I have tenants i selected  from openrent and no issues. 

    They don't even have the decency to do a proper handover but left keys in the key safe. 

    Shocked how they are a big company yet offer such terrible service.

    Does not look terrible on the whole scheme of things !. Probably landlord is not for you.

    It is subjective, what is terrible to me might not be to you.

    I have leased my properties to councils in the past and had better service.

    I now self-manage and select my tenants and that is going well.

    I have rented my properties since 2013 and not had a case like this. 

    In the past, always leased my properties to councils and get direct rent payment and get property back when needed at the end of the lease. I now only have 1 property left with the council. I now use Openrent and new tenancy are now professionals who can comfortably afford rent.

    Hi Zoe, I just saw your post and I'm facing a similar issue. In my case, it's a company set up by a single individual pretending to be a "company let." The full management agent seems to be aware that he's subletting and misrepresented the tenant to me as a rebranded "company let." Now, I have to go through the super long eviction process to remove the tenants.

    I was wondering—did you have to go through possession proceedings to get your flat back?

    No but it took over 12 months since the lease ended to get it back from Mears. I included the council they leased my property to, i made a complaint to their complaint department. 

    Hopefully you get it back soon. It wasn't AST tenancy which made it more complex. Now don't lease to such again.
