Lease has ended but company not leaving

    I have contacted Lisa's Law Solicitors and they have said the same thing that

    Said the first class post letter is deemed valid as per the lease agreement.

    Yes did the first class standard and got proof of postage.

    The services are getting worse by the day.

    The queue at my local post office was terrible but knew what I wanted.

    This is a tricky situation as you won’t be able to take possession until the tenants have left 

    You could issue a notice to quit on the agent, but if after the 4 months the tenants are still there then you still would not be able to take possession 

    One option would he do try and negotiate so that the tenants are compensated if they leave 

    Another option is that the agents transfer the tenancies over to you and then you issue the tenants with notices 

    Would you like to schedule a call to discuss?"

    Exactly, forgot to add that the last option not an option nor compensating them to leave.

    The flat will need some work due to the crap tenant there.

    The tenant also lied that she has 2 children, Mears confirmed from their inspection that there are 2 children and expecting a 3rd. The flat has mould due to their lifestyle and been overcrowded. 
    I do not plan to take them on nor compensate them as the flat will need renovation work done which will cost money plus the below market rent, they have been paying all these years.

    No asked recently not in 2021. Just reading old communication but recently tenant told me she wants a 3 bedroom council property as she has a boy and a girl but from the email in June 2021 states 2 sons and pregnant.

    For a 1 bedroom flat a mother and 3 children is too much pressure on the flat for damages.

    Message yesterday "Just myself and two children. A 5 year old and a 1 year old baby"

    Something does not add up either tenant is lying or Mears counted an extra child wrongly.

    The flat is on the big side and can be converted to open plan 2 bedroom as the front room is very generous with its own private.garden but only 1 bedroom. 

     I want my flat back so keeling my fingers crossed.

    I did inspect the flat today.

    She did say she is bidding and has been placed as priority so hopefully gets re-housed soon.

    Also she has 2 children, not sure where mears got that she has 2 sons when she has 1 and a daughter.

    Also the quit notice has been delivered to Mears and to the address. 
  • Update:

    I took the builder in to assess the works to be done, tenant has confirmed she will be vacating in May.

    The quit notice issued to Mears seems to have made some impact. Will know for sure by May when I get the keys. 

  • Why is the council enabling crap behaviour. I had someone go in to do a gas saefty who has given me information as well that the woman is not living alone with the 2 children but also has a partner so 4 people living in my 1 bedroom flat. I think she is doing this for benefit (get more help saying she is a single parent) Paying crap rent and damaging the flat a lot of pressure on the flat with 2 adults and 2 children.

  • Update: The company sent this yesterday that they have started court proceedings.

    Keeping my fingers crossed get flat back soon.
