Have you started a chargeback via paypal.
Also if i remember right you can get your credit card company involved to chase up the money

    hi
i have done that now, its says

This transaction is subject to a buyer complaint or a chargeback. Go to the Resolution Centre to resolve this issue.

I have filed a distupe on paypal

On my paypal account it says
We have received your claim and have notified the seller that you are dissatisfied with this transaction. The seller's deadline for responding to this claim is 24 Jun. 2005. If the seller does not respond by the deadline, the claim will be decided in your favour. You may cancel this case at any time by clicking the 'Cancel Complaint' link below.

Will this mean i will get all my money back ?

I remember reading somewhere you only get £105 back ?

Halifax will probably not cover this.

Once PayPal have accepted your claim, they will try to recover the transaction total on your behalf, from the seller's PayPal account. If PayPal have received a number of complaints about this seller, they will have frozen the seller's PayPal account, so the seller won't be able to remove further funds. If PayPal can't recover your money from the seller's PayPal account, your claim will pass on to one of the Protection Programs.

It is unlikely that the item was covered by PayPal Buyer Protection. But, if it was, the limit is £500, rather than the £105 cover provided by eBay Standard Purchase Protection. Provided you meet the eligibility criteria for eBay Standard Purchase Protection, you'll at least get £105 back.

I started by saying, "Halifax will probably not cover this." The only chance that they would is if you are overdrawn on your account. In that case, you can try arguing that the purchase was made on credit, and you have rights under the Consumer Credit Act. Because the purchase was for more than £100, you can try holding Halifax jointly liable.

The following should probably be added to MSE's The Six Golden Rules of using eBay: Only ever buy high-value items from eBay using a credit card. It is unfortunate that this is the only way to give yourself adequate protection, should something go wrong.

"Direct Debit is one of the safest ways of paying your bills. Fraud rarely occurs because organisations using the Direct Debit Scheme go through a careful vetting process before they're authorised, and are closely monitored by the banking industry. But if money were to be taken from your account fraudulently you'd be protected by the Direct Debit Guarantee, and would be entitled to an immediate refund from your bank or building society."

would that apply, very grey area.

The Direct Debit Guarantee is a guarantee about the administration of direct debits. It covers errors that are made by your bank or the originator (person receiving the payment), such as the wrong amount being taking, or at the wrong time. It means that the originator must tell you how much they are going to take, and when. And, it gives you the right to cancel a direct debit at any time. Your reference to fraud, in relation to direct debits, concerns someone fraudulently setting up a direct debt, and taking money without your permission.

If you authorised PayPal to take £210.98, and they took £210.98 within the timeframe that they told you, nothing has been done wrong.
