About a year ago, I listed two or three Clarins items. eBay cancelled my listings and sent me a warning about VERO/Clarins wanting to take me to court/I would have to pay a huge fine.
A year has passed and I was thinking of possibly putting the item on again. I contacted eBay and asked if I could. I was told that as long as it didn't have any "harmful ingredients" in it, there was no issue with my listing it again. I mentioned the VERO thing and was told not to worry about it.
Would I be able to list them or is that asking for trouble? It's only 3 skincare items I received when I made a purchase from Clarins in the past - they were free gifts which I won't use and none of my family or friends will either.
I'm not an eBay professional or business seller. I just shove stuff on be it old clothes, old laptops, old mobile phones or bits and pieces I won't use.

On a side note, I stupidly listed an item wrong.
I had 3 tubs of face serum, 15ml and 7ml (free gifts with purchase).
I thought I had created a listing for the 7ml ones but stupidly put the photo of the 15ml one and put 15ml in the listing too.
Buyer purchased.
I sent the 7ml tubs out.
Buyer complained and said she wanted the 15ml ones.
I apologised and said I had made a mistake and can I give you a part refund.
She said no so I told her to open a case and return for a full refund.
I sent a postage label.
She returned but she had emptied all the contents and sent empty tubs back.
It's my own fault for sending the wrong item out but how sneaky was she!

Don't trust the customer support often they have no clue.
Personally I would not sell that brand again if you have had a VeRO strike. Look into it more
before you decide.
Ebay can be funny with VeRO issues, lots of items for sale yet give a few smaller sellers a strike where there

Personally wouldn't list the same items if they;ve already been dinged once as it's not worth the effort/hassle if you lose your Ebay account over it. I imagine it's all automated and you'd have a lot of hassle trying to recover things even though CS have told you it's fine.3

You're both right. It's not worth the hassle. I did think "it's over a year now, they won't realise" but I am sure they will.
I can see lots of other people with the same item, some business sellers and some not. I wonder if they will all get banned too unless they have an agreement with Clarins but good for them.
I think they are doing a raffle at work soon so I will just offer them as a prize for a winner.0 -
I think it is hit and miss with Ebay.
I hadn't realised that Clarins was not allowed till I read this. I have listed Clarins samples over the years - probably got away with it!
A few years ago I listed Chanel samples and I got a warning but then other people had listed the same items - didn't look like business sellers but private small sellers.1 -
My understanding of the VeRO cancellations is an infringement on the brands copy right. For example taking and using photos, text or trademarks from the brands website to use in your listing.As long as you use your own photos and text description I can’t see a problem re listing your unused items.There is a lot of information regarding this on eBay’s own website. So have a read yourself to be sure.1

VERO is more thank that, any company can ask for ‘their’ items to be included on the VERO list and eBay just comply. The one that catches most US sellers out is ‘Velcro’ , that name in the US is fiercely guarded and anything listed will be pulled within hours with a warning given. Sellers are told to use words like ‘sticky hook fastening system ‘ instead.I fell foul of VERO once with a padded jacket that I bought , I’d never heard of the brand but apparently they guarded their name closely and only allowed authorised sellers to sell the brand.The violation is obviously way more complex than I realised but hence me advising to read up0

As for relisting the Clarins items, then I don't think it is worth the risk. The eBay help people generally say what they feel like to get people off the phone. They probably didn't know what Clarins was. Even though you can authenticate the samples, you are not a "permitted" retailer of the brand.Should've = Should HAVE (not 'of')

I tried to sell some new unused (but older version) accounting software that got flagged. I could sell the manuals fine according to the rep and give away the software for free but not sell the software.But maybe I asked the 'wrong' question. Vero should be used for trademark and copyright infringement rather than for brands to abuse in order to control who sells their stuff but eBay have never done much to verify reports are genuine.If a listing has been removed once via Vero it’s not wise to try again.In the game of chess you can never let your adversary see your pieces0
