Hello All,
So I have a few developments here. I have now been given a court date of 15th November 2023. I have also received a letter, dated 2 days after the date of the letter from court, from the Claimant's legal team where they suggest they may be prepared to make an offer to settle the matter. I assume this is standard procedure and that I'm probably best off ignoring it.
More importantly I believe, I now feel I have a stronger avenue of defence against this claim than the original defence I sent. My original defence was centered around the lack of professionalism from the Claimant but I believe arguing "primacy of contract" of my tenancy agreement is a stronger defence - is there anyway to update my defence? I don't think the defences are ultimately contradictory. Thank you all

You will be updating your defence when you do your WS & evidence bundle anyway. The hearing Order tells you your deadline on page two; maybe it's 14 or 21 days beforehand?
And around that time, DCB Legal will discontinue, so there won't be any hearing.
You will win.
And while your case is quiet this Summer, we sincerely hope that you are au fait with the need to respond to the private parking draft Impact Assessment this month?You want to help us change the law?
To be clear, we are nearly there; it's not a petition or some weak campaign, it's a final push on a law already passed, to cap the £PCN levels and ban the fake DRA fees.
The Government has a Call for Evidence open right now.
We are also wanting photos of unmanaged car parks, Hospital car park signs near you that show £50 or £60 as the deterrent, and Aldi, Asda, Tesco or Sainsburys £70 signs please.

If it gives you 14 days and they haven't discontinued by then... of course you have to do a WS and submit it within the timeframe. Just do your WS and wait for the discontinuation.3

I just got a call from DCB Legal, I humoured them without any real intention of taking a deal, the started at £200 (from my apparent £298 bill) and went down to £100. I rejected, they said the offer is on the table for 7 days. Kind of wish I didn't humour them at all so they'd just discontinue. Silly of me. Anyway after just submitting the WS for my other PCNs I will now turn my attention to building the WS for this case!1
