    Can I please confirm that I need to attach just my defence pdf in an email to the CCBCAQ email address and that is it for now? I don’t need to email anyone else this defence?

    That's correct, but keep your eye on that checklist you are following so that you are ready for your next interaction.

    The facts as known to the Defendant:
    2. It is admitted that the Defendant was the registered keeper and driver of the vehicle in question.
    3. The defendant parked in the full, free car park whilst visiting a shop in the retail park to collect an item. The defendant was approximately 10 minutes or less.
    The Claimant has failed to properly plead its case in accordance with CPR 16.4(1)(a) for the following reasons:
    3.1. the Particulars of Claim:
    (a) states that a contract was agreed between the Claimant and the Defendant but fails to explain how or where the Contract was entered into;
    (b) states that the driver was in breach of the Contract but fails to provide any description or
     details as to what term(s) of the Contract the Defendant has supposedly breached that had given rise to the PCN(s);
    (c) refers to “PCN(s)” which implies that there are, or may be, multiple parking charges which the driver and/or the registered keeper are liable to pay. The pleadings fail to provide any adequate explanation as to the number of PCN(s) that the Claimant is seeking to claim against the Defendant together with an itemised list of charges related to those PCN(s) and evidence of incurring/paying 'fees' or 'damages'. The sum claimed is well in excess of the capped level of parking charge potentially allowed by the British Parking Association, of which this Claimant is a member.

    I think that's the best the D can add to the template defence.  Hopefully in the end before the hearing, they'll discontinue.

    UK motorists need you to help us make a difference forever.  What a waste of your time this is, and why should there be such a litigation culture in parking?

    It's horrible being pursued for £100 plus false 'fees' for no reason, by an ex-clamper aggressive firm, isn't it?

    Join us in pushing to end the PPC and DRA 'added fees' rubbish that pays for the bulk-litigation culture.

    There will be one window of opportunity very soon, early this year.

    Together, we can stop the parking industry from riding roughshod over the new statutory Code of Practice and reinstate the lower charge level caps and the ban on added fake fee 'extortion'.

    PPCs have blocked the new statutory Code with Judicial Reviews.  Stopped the much welcomed parking code from February 2022, which stated that added £60 or £70 false 'DRA fee' extortion was to be banned and that parking levels would start at £50.

    It's all on hold...!  It needs to be law.

    This will be your chance to make a difference, plus other drivers you know (family, friends) who are also fed up with greedy and unscrupulous parking firms and the stranglehold they and their 'legals' have on people.

    This upcoming Consultation needs high numbers of real victims to make a point of responding.  Coming soon....and it will be all over the forum, you'll see.
