  • Cheers got it now. My SAR has come back and my valid parking ticket had slipped down the dashboard slightly so was still visible but the valid date at the bottom was not entirely visible. Completely immoral!!! Surely I can defend based on still having the ticket for the car park from the hotel and the invoice to prove my stay on that particular date?

    You need to understand THEIR business model. They are running a money making machine dressed up as parking management. Employing people with brains, ethics or legal qualifications is expensive, so they don’t bother with doing that. It is far far cheaper to use the Courts. Taking the occasional loss when a victim refuses to give in is merely seen as a business cost. A cost which is much lower than employing someone capable of reading and understanding anything you say.

    It works because too many give in and pay up, funding the losses in Court and leaving plentiful profits for the scammers.

    Of course you can defend and you will win, just don't expect any sense from the pcc or their dodgy legals. It's a process which you either give up and pay or press on with and win.

  • Thanks all I’m going to press on with my defence now I have received what I requested in the SAR. If I win am I entitled to any compensation due to this harassment!! It’s been 6 years since the ticket has been issued and letters from various debt collectors since then!

    No you aren't but you know from the NEWBIES thread that if it gets as far as a hearing, you can claim limited costs.

    The various stages are fully explained under the red capitals heading IMPORTANT:  KNOW WHAT HAPPENS WHEN, which is in the 2nd post of the NEWBIES thread.

    Be prepared for each stage.  Defence is not your only job!

  • Defence submitted yesterday morning, deadline was 4pm yesterday. Acknowledgment received. I understand next steps but would like guidance on what I can counterclaim for - I’ll be having to use annual leave to attend court. Thanks guys

    You can't counterclaim. Costs are not a counterclaim.

    Costs are mentioned in the NEWBIES thread section 'KNOW WHAT HAPPENS WHEN' and if you look at the Template Defence you submitted, it already mentions the CPR rules on costs at the end.

    Then if you look at recent WS bundles people have posted here on threads, you'll see their costs assessment sheets.
