Extension doesnt show on title deeds

  • I think this is more the buyer than the solicitor, but we dont seem to know exactly what his solictor is advising!!!.  The land boundaries are all correct on the plan.  It all seems to be adding extra solicitor costs on both sides.

    I would suggest asking @Land_Registry in general terms (i.e. not sharing your reference number publicly) on this forum, rather than running up your solicitor's costs....

    If it is something they would do then it would be useful to know, and also whether there would be any costs involved.

    My purchase was a first registration. The only plan was that from about 1890 when someone bought 3 plots on which to build. 

    I was given this by the solicitor with instructions to work out on which of the plots my house had been built, and it was explained how important this was! Great way to meet the neighbour's way before I moved in.

    Can you stop talking to him directly and ask that he goes through the solicitors so they can discuss this amongst themselves. Hopefully the solicitor will then explain it isnt needed. 

    What is strange is the solicitor would not order the searches without confirmation from the buyer that the title plan reflected the property he was buying, so why is this only coming up now?

    The solicitor can order searches whenever they want, there's no need for them to wait for that confirmation (unless they're looking for excuses to stretch out the process even more than it already is).

    Unfortunately the OP appears to be getting into a contract with a moron, but it's a bit late to do anything about that.

    LR don't issue new plans, they issue what is on file.  

    If the buyer wants a new plan they will need to pay to have one prepared and agreed between both parties. More delay and expense and the extension may not even be on the latest OS base plan.
  • Thanks for all your comments.  I've emailed land Registry if they can add the extension to our title plans.
    We have never spoken to the buyer directly, the conversation has all been through the solicitors and i know our solicitor is getting fed up with the situation!!
    I am starting to wonder how serious our buyer really is.

    Why do I get the feeling that this is a first time buyer?

    It's highly unlikely that Land Registry will update the plan.  If they do then it won't be done as a priority so you'll probably be waiting months.

    Personally I would ask them (through my solicitor) to explain why they feel it is necessary to have irrelevant detail included.  I would also be contacting my EA to tell them to prepare to re-market the property.

    Indeed!  A good Estate Agent can tell the buyer it's not a thing, and won't be costing you solicitor rates to do it!  Maybe get your EA worried they won't get their commission for ages yet, because the buyer is creating nonexistent obstacles.
