You are fully aware that you are dealing with a bottom-dwelling law firm that has a terrible reputation and acts for the equally sub-gutter PPCs. Their employees appear to be intellectually challenged at the best of times and, as in this case, have obviously ignored your point about the EA2010.
Nothing more you can do for now except wait for the allocation of your claim to your local court and to submit your WS. Move on with your life for now. As it is DCB Legal, you can possibly expect them to advise their client to discontinue at a late stage in the process because they know how sore their bottom gets when they get their usual spanking in the court.

Dear Amy,
Thank you for confirming that your client is content to remain in breach of the Equality Act and seems to think they are above the law.
I'd bring on the fully expected discontinuance if I were you. Save yourselves the hearing fee.
Finally, re the way you obtained my data, please confirm: is DCB Group operating a model rather like MIL Collections? It has been said in certain circles that what you are doing in bulk - with hundreds of discontinuances and little or no evidence of a client-led appetite for hearings - looks very similar. Debt purchase, in case you don't understand the reason for the question.
Can you tell me if you've paid your client any money (in advance of any monies being collected) for my data, or for the batch of data mine was in? If you refuse to answer I will report DCBLegal to the ICO.
yours sincerely,PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The reply:
We write in response to your recent email.
It is our position that our Client has not acted in breach of the Equality Act. As previously stated, all Vehicles remaining on the Land in excess of 2 hours are required to make payment for parking. Your Vehicle remained on the Land in excess of 2 hours, yet our Client holds no record of any payment for parking, therefore; the Parking Charge Notice ("PCN") was issued correctly.
Our Client is regulated by the British Parking Association ("BPA") and was therefore permitted to request details of the Registered Keeper of the Vehicle from the DVLA in order to issue the PCN. The DVLA provided your name and serviceable address, and confirmed that you were the Registered Keeper of the Vehicle at the time of issue.
DCB Legal were then instructed to commence legal proceedings as a final resort, in an attempt to recover the balance owed. For the avoidance of doubt, DCB Legal are a legal firm fully regulated by the Solicitors Regulation Authority ("SRA").
We trust this clarifies our position.
Kind Regards,
Amy Stephens

Dear Amy,
No it doesn't clarify what I specifically asked.
It was a vital point about your position regarding whether DCB Group (under any iteration) are assigning debts and/or have paid, or are committed to paying, your client any sum up front for data, including my data, whether or not you succeed in extracting money from me.
Wanna have another go?
My complaint to the ICO is ready to go and I will also refer my case as a complaint to the DVLA, if you are unable to confirm that DCB Group are not either assigning alleged debts or involved in a debt/data purchase arrangement whereby you advance or promise money (or a percentage per data set) to UKPC whether you obtain payment from consumer victims or not.
I don't know, but your model looks to operate that way to a number of right-thinking people, which is why I asked.
If you don't know, I suggest you take legal advice.
You have until the end of March to clarify.

You may find this article interesting, Nicolas Bowen fell asleep at a services car park and overstayed the two hours. Parking Eye pursued him through the courts and I will let you read the rest.

I wonder if 1) he would have been awarded costs if he had not been a QC and 2) why did the judge award costs in the small claims court, there must have been some really unreasonable behaviour on the part of the claimants.4
