    What exactly did you send to Moto to get that reply?

    Depending upon your answer to that question you could send something like this back - others on here will be able to critique/add to it

    Thank you for your reply on this parking charge notice, issued by your agents CP, plus/group Nexus .
     I am a little bit confused by your replay/stance on this matter, where you state that CP Plus/Group Nexus are responsible for managing parking at Moto locations.
     As principal you are jointly and severally liable for the actions of your agents, and this includes un regulated parking companies such as CP plus for an on your behalf. The British Parking Association limited  with its so called code of practice, which was drawn up by the parking industry for the benefit of parking industry.
    And I am also sure that you should be aware that the British Parking Association limited  is not in any way  a regulatory authority , merely a trade association.
     With all that in mind, I am a little confused as to why you seem unwilling to instruct your agents,  Group Nexus to cancel this parking charge notice , as dealing with this un regulated company is causing myself a lot of stress, worry and is also consuming a lot of my valuable time

    Not an unexpected reply.  There was a time MOTO would cancel but I guess Group Nexus who by the way is a simple two man band, told them they cannot cancel

    CP Plus are just another parking scammer and we must assume that they are the organ grinder and MOTO is the monkey ?
    Sad for the CEO of MOTO losing control and being the monkey

    The two hour limit is just a money trap, these motorway services are normally in the middle of nowhere and there is no reason for anyone to abuse the car park. Infact it is MOTO who abuse their customers ..

    OVER THE TOP EXPENSIVE FUEL
    EXPENSIVE SHOPS AND EATING PLACES

    MOTO has no respect to signs on the Motorways ... "TAKE A BREAK, TIREDNESS KILLS" .... 

    Will a court judge allow DCBL the pleasure of winning when DCBL apply fake charges to their claims ?  and worst of all, DCBL use a person who may be real or may not, to sign a statement of truth for the fake amount 
    CONTEMPT OF COURT will soon be a reality for DCBL

    Whilst you prepare your WS with the help on here, also prepare your costs for when you win.  

    And, advice to everyone, you do not need to visit MOTO or Roadchef 
    Fill up in your local garage, if you need to re-fuel turn off at the many junctions where a petrol station will be easily found. 
    PACK YOUR OWN FOOD.

    If you need a pee, use the 2 hour limit and exit ASAP

    There is no reason to stop at MOTO and you should tell your friends and family

    Does the CEO of MOTO have a clue that MONEY SCAMMERS in their car parks is LOSING THEM BUSINESS ?

  • If you think it's bad as a visitor I've had the misfortune to spend a few hours through an agency working there many years ago. The experience included scraping years of filth and broken glass from underneath kitchen counters, losing papadums in the murky depths of the fryer oil that had never been changed, stomaching the racist comments from senior members of staff, getting locked inside the walk in freezer that had no - legally required - means of opening the door from inside and witnessing customers storming out because the shocking customer service. The !!!!!! just drips down from management through to customers.

    On the evening of 24/06/2019 I stopped at Leigh Delamere Service Station to help a friend who was feeling unwell. She had recently visited the doctor and been given a blood glucose monitor. We stayed at the services to make sure she was well enough to go home and at the time visited shops and toilets (where she was sick) to try and facilitate her recovery. Several days while later I received a Parking Charge Notice (2000010257800) that I had been charged a fine for staying longer than 2 hours! However it took that long to help my friend feel better and there were no clear signs to convey the length of parking. On a subsequent visit the sign was found to be obscured by other vehicles in the car park. I attempted to contact the manager at the time to explain our situation but while the member of staff who contacted the manager was very polite and helpful the manager rudely refused to talk to me. To quote your own website "We want you to unwind with us and leave feeling refreshed and ready to hit the road. That’s our mission!" Sometimes this takes a little longer that 2 hours!

    I've now received a County Court Claim in excess of £300 for a few extra minutes in the car park. 

    I hope I've made our situation clear enough and you are able to facilitate in cancelling this parking charge before it escalates further.

    You need to cite (in the defence AND in your next reply to MOTO telling them to tell their agent to cancel the PCN/claim) the Equality Act 2010.

    If this passenger is continuing to suffer from a long term condition that is likely to continue - or remit/repeat - for more than 12 months (diabetes? Chronic & continuing high or low blood sugar?) then they have a 'protected characteristic' under the EA 2010.

    As such, they passenger was legally entitled to the 'reasonable adjustment' of more time than the fixed policy of 2 hours.

    This is unequivocal, it is the law and MOTO and Group Nexus both failed to make extensions of time available to visitors with protected characteristics.  The claim MUST be cancelled.

    Have received letter from DCB Legal informing intention to proceed with the claim and including a copy of the directions questionnaire which I believe I ignore and wait for the proper one to come through from the court.

    My complaint via the MOTO website and response to their customer satisfaction email have both been ignored which included this message

    Reply to DCBLegal by email (search the forum) and use my wording about the rights under the EA and tell them to discontinue.  Sometimes it helps to give them a prod.

    Don't write that you are 'confused'. Write what I said and attach proof of longterm medical condition, disability (or Blue Badge).

    Don't say you are confused, they will try to confuse you even more

    Doubt they want to get involved in the EA or a court spanking so be patient, DCBL offer a fun times game so play along with them

    Their response:

    We write in response to your recent email.

     

     

    Please note, all Vehicles remaining on the Land in excess of 2 hours are required to make payment for parking.

     

    Your Vehicle remained on the Land in excess of 2 hours, yet our Client holds no record of any payment for parking.

     

    It is our Client's position that the Parking Charge Notice ("PCN") was issued correctly.
