Sorry to revive my old thread, couldn't see how to start a new one. So I have managed migration completed, my situation is we claim UC as a couple, wide gets carers allowance for my disabled pension mother, also earns £120 a week as a carer assistant.. and I earn £240 ish a week self employment, i could earn more but im struggling with my health regards to my back, been with consultant for a number of years but its flared up last 3 months so i cant realy work more hours but i am told i need to do job search..i am dealing with my health issues.. I think even Need claim pip, because I can't sit for more then half hour and walk another 20 minutes, before I need to lay down 40 minutes for my back pain to calm down. What you guys recommend I do with regards universal credit, I suspect I have spinal instability, i have appointment with consultant next month, suppose to be earlier this month but he cancelled... also I won't be able to claim after a year anyway because I will have 16k + savings. Not sure what to do in my situation.0

So you transitioned from WTC to UC as a couple, at the point did you have over £16K in capital (savings as you say). If so you have a year’s transition protection. After which your UC will end if you still have over £16K in capital.
As PIP is not means tested the amount you have in savings/capital is irrelevant. You will however need to have the condition for 3 months and likely to have it for another 9 months to claim PIP. I would seriously recommend looking at the PIP activities to see if you fit the criteria. Sitting for a set period of time is not taken into account in PIP and walking for 20 minutes would imply you can walk over 200 meters. It might be worth starting the application and then seeing the consultant and deciding if you continue with the application depending on what they say.

Have a read of this before deciding whether to apply. https://www.gov.uk/government/publications/personal-independence-payment-assessment-guide-for-assessment-providers/pip-assessment-guide-part-2-the-assessment-criteria#daily-living-activities

For UC you can get a fit note which has the option of saying you are fit for work providing you have version restrictions/accommodations. This is what they accept as proof of a health condition, for your work coach then to use their discretion to reduce work requirements.
That's what happens normally.
However your earnings above 16xNMW/wk mean you can't be referred for a work capability assessment. Usually work coaches turn off requirements while somebody is awaiting a WCA decision, but I don't know what they would/can do if you can't have a WCA - hopefully other members may know what happens in this kind of situation?1 -
I can't bend down with getting pain also in the last three months I have lost lot of weight and gone weak, I have had my kids and familys help just to get some minor stuff, feeling debilitated. I don't what steps I should do to stop the work search and going forward apply pip as this could become a downward spiral of me getting weak

As said, you need to get fit-notes from your GP and report a health condition on your UC journal under Home>Report a Change>Health. The fit-notes support that report and show that you should be treated as having limited capability for work which should switch off or greatly reduce the jobseeking commitments. Then as your earnings are too high for you to be referred for a Work Capability Assessment I believe that you would simply keep providing new fit-notes as needed until your 12 months transitional entitlement to UC ends.2

Changes that end transitional protection
Significant changes to your circumstances will end your transitional protection. The following are considered as significant changes:
- a partner moving into your household
- a different partner moving into your household
- a partner leaving your household
- your earnings drop below an agreed amount for 3 months in a row
- your Universal Credit claim ends
So if your earnings were to drop for 3 months in a row due to you not working, that could end your entitlement to Transitional Protection.

So basically I really need to provide a fit note, so I can take time of when I need to, at the moment I am forcing myself through the pain, also keep making it worse as I try to fight through it, which is not the sort of thing you do when you have a lumbar disc issue.. also what is the agreed amount I have with jobcentre? I don't even know, also do they consider my partners earnings aswell as mines. Alao can someone guide me how to do the fit note? And which one shall i provide. Thanks for the help guys0
