  • I too parked in this car park on 8th December 18.30pm it was dark and raining but there definitely weren't any signs up. I have not received any correspondence until Friday 10th February when I have a letter threatening court action and a £170 fine! This is from Gladstones I have also had a text telling me to pay with a link in it. The letter is dated 30th January giving 30 days - help!

    You all need to pm each other and send a joint complaint to the BPA.

    The PPC has responded to my MP with practically the same comments used in their POPLA submission.

    "I have attached an image...which shows lighting in the car park" [ie, one light on the far side that leaves most of the area in darkness].
    "...attached signage that is in place..." [close-ups taken in bright sunlight].
    "We have not received any other complaints" [so they say - and how many people's initial reaction is "it's a fine - must pay"?].

    Not exactly surprising - why would they back down or even reach a compromise now?

    My MP has said he's sorry not to be able to provide a more positive response and said I can continue to contact him. Apart from highlighting the forthcoming public consultation, is there anything else I should ask him to do?

    The case is still with POPLA, I submitted my comments on the PPC's submission last week.

    UPDATE:

    Several weeks after I uploaded my response to the PPCs "evidence", POPLA have contacted me to confirm my appeal was successful! :)

    I'll post the full text in the POPLA decisions thread, but they basically said that the operator only provided close-up images that didn't show how the car park was illuminated, so the assessor could not conclude the T&Cs were visible, therefore they were not satisfied the PCN was issued correctly.

    I'll pass this onto my MP and councillor in case anyone else in the area needs help.

    Well done. Don't forget to come back for the next DLUHC Consultation, exact your revenge on the private parking sector. Bookmark or set up an alert to the following thread where the first announcement of the opening of the consultation will appear.

    This thread is over a year old, but the original poster has said they were going to upload their appeal/decision to the PoPLA decisions thread. Have a look at that, starting at the last post and moving backwards. Also look at the third post of the NEWBIES sticky Announcement as I have already advised you to do on your own thread.
    I suggest you also stick to your own thread where you will get bespoke advice.
