SAR sent, and here's the response...

Hi,
I received a PCN earlier this year from Ocean Parking operating at the Stockport Peel Centre car park. After a while I received an Letter Before Claim. I followed the steps om the NEWBIE thread by sending an SAR to the DPO and sending the lawyers an email about my SAR request to and hold the case.
I have had a response from the DPO and they are refusing to pass on the PDT machine record for that day. The NEWBIE thread says to insist on getting this data, which I did again, but the DPO responded that this was sensitive commercial information which does not relate to me. I did suggest they can redact parts of the VRNs but still no luck with the DPO. Last thing the DPO wrote was "There were 3,714 vehicle registrations recorded on the system for the date in question, and this data refers to other vehicles, and there is therefore no requirement for Ocean Parking to share this data as part of the SAR, when this does not contain any of your personal data, as well as being commercially sensitive). Should the matter go to court, then any data of this nature may be considered on request by the court."
I have also sent a complaint to Ocean Parking as an "angry customer, dissatisfied with the unlawful methods of the debt collectors and legal partners, and that will not be returning to the retail park" -- along those lines.
I am unsure on what to do now. Do I sit and wait and see what happens?

They are right in that, it is not your data, you can "put the claimant to strict proof that your VRM was/was not" on the machine record for that day during the defence process once you get a claim form. Let them tell a judge they cannot see it! You can complain to the Stockport Peel Centre and ask them to get it cancelled as you were a valued customer that day and if they want to keep you, your family and friends as customers in the future they should call off their parking dogs!

Ocean Parking just like the rest of this mickey mouse industry live a life in another world. Of course every company must apply data protection but they use this as an excuse

It's simple enough, if the court requests the information so they can prove their claim, they are not in a position to consider it, yes they can decline but no proof means no case to answer
CASE DISMISSED.
I am puzzled ..... has a company been set up to provide these replies for the scammers, we really are seeing a lot of rubbish nowadays2 -

Update: still not heard anything from the carpark or CST Law. Not sure what's happening now.
I have heard recently that more and more PCNs are going to court now after a recent law has changed which makes it easier for companies to fight and win these cases? Is this true?0 -
Nope, the opposite is true.
You might get a claim - but there's no new law supporting it. In fact the law is changing to quash rogue conduct in about a year's time. The Government is stepping in.
What trash did you read, some clueless advice talking about ParkingEye v Beavis from seven years ago as if it's news? It's not new.
Please don't just go away from the forum though, because you might get a court claim to defend at some point, from a solicitor. Never say never!
We sincerely hope that you are au fait with the need to respond to the final Government Public Consultation?
