Appealed as registered keeper against Parking Charge Notice

This is my first post. I have read the NEWBIES thread. I have used the template in that thread to appeal against PPS(Private Parking Solutions) via e-mail. I appealed as the registered keeper after receiving this parking charge notice. I have not divulged the driver .There was no windshield ticket. I also included some pictures as evidence. Here is the response.


(Please be advised that when a vehicle is parked in a private car park, the normal rule is that the DRIVER is responsible for paying the tariff fee (if any) for parking, for following the terms and conditions which apply, and for paying any parking charges.

Please note that within your appeal you did not nominate the driver at the time of the parking event and now you have a number of options:

If you wish to give the details about the driver (full name and current address for postal service) we will transfer the liability for the PCN.

If you refuse to give the driver' details, we will be able to pursue the registered keeper under Schedule 4 of the POFA act 2012.

If you are submitting this appeal on behalf of the driver, please include evidence from the driver to show that they have nominated you to appeal on their behalf.)

In the NEWBIES thread, the first letter you receive is essentially the NTK so I appealed immediately. What should I do now? The letter says " we have issued PCN to your vehicle because it was parked in a manner whereby the driver became liable for a parking charge...."

      Do I need to respond to the e-mail requesting driver details etc? What happens when I don't respond?

    I guess I have to wait for another letter then as I have already appealed as the registered keeper and yet they sent this reply. If you refuse to give the driver' details, we will be able to pursue the registered keeper under Schedule 4 of the POFA act 2012.

    I have now received a second letter from PPS as below. They haven't rejected my initial appeal but sent me another reminder notice. What should I do now? I haven't identified the driver. Will I repeat the appeal? There is a threat of passing the case to a debt recovery agent.

    Why not complain to the BPA about the lack of rejection letter & POPLA Code?

    I appealed online and I was expecting a rejection letter. After I complain to BPA, what else should I do to help my case? I intend to resubmit my appeal. Would this be a good idea?

    Get a landowner cancellation. If you can't, next stage is POPLA, if that fails (over 50% do), you still don't have to pay the charge. Then see what the PPC will do thereafter. That's about it.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
